<br />CITY OF SEWARD, ALASKA <br />PORT AND COMMERCE ADVISORY BOARD <br />RESOLUTION NO. 2000-03 <br /> <br />A RESOLUTION OF THE PORT AND COMMERCE ADVISORY BOARD OF THE CITY OF <br />SEWARD, ALASKA, RECOMMENDING AN AMENDMENT TO THE RULES, RATES, CHARGES <br />AND REGULATIONS FOR PORT AND HARBOR FACILITIES <br /> <br />WHEREAS, a proposal has been made for the construction or reconstruction of a new <br />replacement dock and float and two fish cleaning stations at Band] floats within the Seward Small Boat <br />Harbor (the "improvements") and for the City to bOlTOW money and issue its revenue bonds for the purpose <br />of financing the costs of improvements; and <br /> <br />WHEREAS, the "improvements" are and will continue to be used primarily by vessels carrying <br />passengers for hire; and <br /> <br />WHEREAS, passenger vessels using the city's docks and small boat harbor facilities impact the <br />harbor facilities and operations throughout the small boat harbor by large numbers of people traveling on <br />the ramps, docks and walkways to board vessels; and <br /> <br />WHEREAS, the estimated cost of the improvements is $3,000,000 which would be paid through <br />the issuance of said revenue bonds by the City; and <br /> <br />WHEREAS, in order to retire the bonds authorized to provide amounts to pay for the <br />improvements, the City would, among other things, agree to collect passenger fees in an amount sufficient <br />to pay operating expenses and debt service on the revenue bonds; and <br /> <br />WHEREAS, pursuant to Seward City Code Section 7.10.610, the City Council shall set, by <br />resolution, the rates for use of all harbor facilities. <br /> <br />NOW, THEREFORE, BE IT RECOMMENDED BY THE PORT AND COMMERCE <br />ADVISORY BOARD OF THE CITY OF SEWARD, ALASKA, that: <br /> <br />Section l. The Port and Commerce Advisory Board finds that the cost of maintenance of <br />the small boat harbor are increasing as a direct result of increases in use of harbor facilities by vessels <br />carrying passengers for hire and funds are necessary to cover the improvements, depreciation, and <br />operation and maintenance of the small boat harbor facilities, including a replacement dock and float and <br />two fish cleaning stations at Band] floats within the Seward Small Boat Harbor. <br /> <br />Section 2. Subsection 230(a) entitled "Passenger Fees" of Section II entitled "Services and <br />Charges" of the Rules, Rates, Charges and Regulations for Port and Harbor Facilities, Seward, Alaska" <br />should be amended as follows: <br />
