RESOLUTION 2005-25
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, DE TERMING THAT IT IS IN THE PUBLIC'S INTEREST TO
WAIVE THE NORMAL BID PROCESS PER CITY CODE ~6.10.130, AND
AUTHORIZE THE CITY MANAGER TO ENTER INTO A CONTRACT
WITH THYSSEN KRUPP FOR AN AMOUNT NOT TO EXCEED $50,000
FOR THE PURPOSE OF COMPLETING REPAIRS TO THE COMMUNITY
CENTER ELEVATOR AND APPROPRIATE FUNDS
WHEREAS, the community center elevator has become umeliable; and
WHEREAS, replacement of the electrical controls and electronic controller system will
enhance the reliability of the elevator; and
WHEREAS, the City's maintenance contractor, Thyssen Krupp, has the necessary
hardware and expertise to fix the failed systems; and

WHEREAS, it is in the public interest to waive the normal bidding process per City Code
96.10.130 for the following reasons: 1) there are only two elevator maintenance companies in
Alaska; 2) Thyssen Krupp currently has the maintenance contract for the repair and maintenance of
the Community Center elevator; and 3) it is important to have properly functioning elevators prior to
the summer season.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA that:
Section I. The Seward City Council determines that it is in the public interest to waive the
normal bidding process per City Code 96.10.130 for the reasons described in the recitals above,
which recitals are incorporated herein by this reference and authorize the city manager to enter into a
contract with Thyssen Krupp, in substantial form as attached hereto, to repair the elevator for an
amount not to exceed $50,000.
Section 2. Funds in the amount of$50,000 are hereby appropriated from the General Fund
fund balance, account no. 101-0000-3070-0667 to the capital project account no. 667-0000-3070-
0101.
Section 3. This resolution shall take affect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 11 th day of
