CITY OF SEWARD, ALASKA RESOLUTION 2004-001 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING LEASE AMENDMENT 2 TO LEASE RE-97-107 FOR SALTWATER SAFARI, EXTENDING THE LEASE TERM TO JANUARY 11, 2034 WHEREAS, Robert Candopoulos currently leases Lot 12, Block 6, Seward Small Boat Harbor Subdivision for the purposes of operating Saltwater Safari Company; and WHEREAS, Mr. Candopoulos plans to expand his facility; and WHEREAS, in order to obtain more favorable financing, Mr. Candopoulos requests an extension of the lease term to January 11, 2034; and WHEREAS, the City Council has determined that the continued development of the harbor area and operation of a charter business and lodging Lot 12, Block 6, is in the public interest. I NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Manager is authorized to sign Lease Amendment 2 to Lease RE-97 -107, in substantial from as attached hereto and incorporated by reference. Section 2. This resolution shall take effect 30 days after adoption and posting. PASSED AND APPROVED by the City Council of the City of Seward, Alaska this 12th day of January 2004. Beckham Agenda Item: Authorizing Lease Amendment 2 to Lease RE-97-107, Extending the Lease Term to January 11, 2034 from September 23, 2017 BACKGROUND & JUSTIFICATION: Mr. Candopoulos is expanding his business and upgrading and remodeling the building on Lot 12, Block 6, Seward Small Boat Harbor Subdivision. In order to obtain more favorable financing for his project, Mr. Candopoulos has requested a change in the lease term for the property. The lease runs through September 23, 2017 and the lessee requests a change in the term to run through January 11, 2034. The lessee is current on all real, personal and sales taxes, utilities, lease payments assessments, licenses and required insurance. An appraisal is not necessary at this time because the year 2000 reappraised rates from the prior leases will be continued, and the lease rates will be adjusted in 2005 and each five years thereafter under the terms of the lease. 1. Other: Municipal Lands Management Plan X Leases: …continue to dispose of commercial and industrial lands through long term leases… Small Boat Harbor Management Plan Lands: …ensure that existing lease sites are fully developed… FISCAL NOTE: Estimated staff and legal time costs to prepare the documents associated with this lease amendment is $1,000. These leases generate $4,600 in annual rent. Approved by Finance Department RECOMMENDATION: Council approve Resolution 2004-01, authorizing Lease Amendment 2 to Lease RE-97-107, extending the lease term to January 11, 2034. Page 1
