NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA that: Section 1. The City Manager is hereby authorized to purchase repair parts for the 1996 Oshkosh Snow Blower from Resurrection Bay Auto Parts in the amount of $27,200. Section 2. Funding in the amount of $27,200 is hereby appropriated from the General Fund fund balance account no. 101-0000-3050 to the snow removal repair and maintenance account no. 101-1314-5380. Section 3. This resolution shall take affect immediately upon its adoption. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA that: Section 1. Authorize the City Manager to enter into a sole source purchase in the amount not-to-exceed $19,105.88 for the purchase of a "LSCAN l OOOTvS Live Scan Fingerprint System, and utilizing funds from existing police department budget. Suaporting Justification: ProComm is Motorola's authorized distributor, installer and maintainer in Alaska. The contract includes professional services (engineering). The federal funds grant was awarded through the Office of Homeland Security based on grant request as specified, award contains specified equipment. ProComm Alaska is a state contractor with a local office, and the City of Seward `would benefit from the State discount price schedule. Management of this project is the responsibility of the City of Seward and not the contractor. Because the current long-term care facility has reached the end of its useful life, the reimbursement rates from Medicaid have been significantly reduced. This is a short-term financial problem which was clearly understood by the City Council and the community prior to the City's decision to enter the business of providing long-term care services. In the long-term, the co-located hospital and long-term care facility is expected to operate in a positive cash position. However, in the short-term, the City anticipates operating losses less than $600,000 per year beginning in January, 2007, until the facility opens its doors. This equates to approximately 50% of the original estimated losses, and is due to cost containment by the Providence management team, as well as to the renegotiation of management fees in the recently-approved management agreement. Since January, 2007, the hospital has experienced operating losses totaling approximately $650,000. The City Council appropriated $500,000 to cover these losses on September 8, 2008. This resolution replenishes the operating loss account, and allows the city manager to draw from this account to cover operating losses between now and the end of the year, as required by the new management contract with Providence. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA that: Section 1. The amount of $695,000 is hereby appropriated from State legislative grant funds account no. 666-6662-4680-0200, to pass through account no. 666-6662-5998. Section 2. The City Manager is hereby authorized to negotiate for the acquisition of nine parcels according to the map attached hereto, in accordance with Council direction as provided in an executive session, and subject to final Council approval and to receipt of all necessary project permits. Section 3. The City Manager is hereby authorized to facilitate - subject to final City Council approval, and subject to the receipt of all necessary project permits -- either the direct purchase of properties and their placement in a conservation easement, or alternatively, to transfer funding to a non-profit entity authorized by the Army Corps, subject to that entity's written agreement to purchase the identified properties, place them into a conservation easement, and manage the properties for conservation purposes, in perpetuity. Section 4. The City Manager is hereby authorized to satisfy the requirements of the Japanese Creek levee project mitigation plan, in conjunction with the Army Corps, to include compensating for impacts to fish habitat and facilitating mitigation and conservation efforts. A monitoring plan would be drafted and followed to ensure that mitigation is conducted during and following construction. • Staking will be done along the levee/road footprint prior to construction to ensure that disturbance impacts are limited to that area. • The clearing limit will extend only to 10 feet beyond the structural fill in order to place excavated fine grain material on the levee/road slope. The fine grained material will minimize hydraulic conductivity through the levee. • Temporary impacts to wetlands will be minimized during design by limiting staging areas in wetlands. • Where work extends beyond the clearing limits, temporary impacts to wetlands will be minimized by working off mats or timbers in these locations. • Only clean fill material will be used for the levee/road embankment to limit sediment laden runoff into Japanese Creek, Resurrection River, and adjacent wetlands. • To limit embankment erosion and down gradient sedimentation, Best Management Practices regarding erosion and sedimentation control will be employed during construction and permanent measures will be employed as early in construction as possible. These BMPs include, but are not limited to: o Prior to fill placement, a silt fence or similar structure will be installed on a line parallel to and within 5 foot of the proposed fill toe of slope within all wetland areas that contain standing water that is connected to any natural body of water or where the fill toe is within 25 feet of such a water body. This structure will remain in place until the fill has been stabilized or contained in another manner. (Silt fences will be installed if the construction activity is occurring during the time that the water is in a frozen state.) o Bank cuts, slope, fill, bottoms of road side ditches, and exposed earth work, especially levee construction and road building activities, will be stabilized to prevent erosion both during and after project construction. o Silt fences or other appropriate methods will be employed, as necessary, to filter or settle sediment runoff. Silt fences or other structures will be maintained until disturbed or deposited material has been stabilized against erosion. o A vegetated swale will be constructed down slope on the protected (non flood) side of the paved levee/road to trap sediment. o Native grass seed will be placed on slopes on the protected (non flood) side of the levee/road to prevent the erosion of fine-grained material from the slopes and into the adjacent wetlands. Parks and Recreation was painting bathrooms, the Hoben Park Fountain was completed, and Sports and Rec was busy with leagues, tournaments, and various community events. In other areas, the final price of the Long Term Care Facility construction was $21 million and change, which was down $2.3 million from the Unit Company bid, as directed by the council. Oates thanked Frank Dahl and The Pit Bar for their many contributions and fundraisers in the last year. The City of Seward received their recertification as a Tsunami Ready community along with attaining the Storm Ready designation. Informational sheets on the two ballot propositions went out in utility bills this week as well as online. Oates met with the Chamber to discuss these initiatives and the efficiency study. Council had conducted two work: sessions on the efficiency study, and more were to come. Oates hoped to get through these issues before the budget time. City Attorney's Report. Cheryi Brooking stated the attorneys gave advice nn taxes and fees, proposed contracts, resolutions, ordinances, adminstrati~ e matters, employment issues, ballot and voter qualification issues, aspects of the proposed levee project, options to extend leases, lease amendments, and provided information on flood management. With regard to the Small Boat Harbor and SMIC, the attorneys provided assi stance with various hay°bar and SMIC land use matters such as harbor compliance, environmental issues, leases and contracts. The attorneys continued with on going mediation and settlement discussions ~~~ith the Resurrection Bay Conservation Alliance lawsuit. Port and Commerce :advisory Board Report. Ron Long stated the board passed a resolution to come forward ro c~conimend a zoning district and potential uses for south harbor uplands. The board thought it best to be less restrictive in the uses allowed and many possibilities were suggested. He wele~med-Mari Anderson as an ex officio member of the PACAB and mourned the loss of staff, as Anne 13ailey would no longer provide administrative support to the board.
