RESOLUTION 2008-091
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO PURCHASE REPAIR
PARTS FOR THE 1996 OSHKOSH SNOW BLOWER FROM
RESURRECTION BAY AUTO PARTS FOR AN AMOUNT NOT-TO-
EXCEED $27,200 AND APPROPRIATING FUNDS
WHEREAS, the Public Works Department experienced a mechanical failure of the 1996
Oshkosh Snow Blower; and
WHEREAS, the Public Works Department issued an Invitation to Bid for the purchase of
the necessary repair parts; and
WHEREAS, the Resurrection Bay Auto Parts store in Seward was the only responsible and
responsive bidder; and
WHEREAS, the procurement of these parts is necessary to enable the Public Works crew to
load snow with the Snow Blower.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA that:
Section 1. The City Manager is hereby authorized to purchase repair parts for the 1996
Oshkosh Snow Blower from Resurrection Bay Auto Parts in the amount of $27,200.
Section 2. Funding in the amount of $27,200 is hereby appropriated from the General Fund
fund balance account no. 101-0000-3050 to the snow removal repair and maintenance account no.
101-1314-5380.
Section 3. This resolution shall take affect immediately upon its adoption.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD
ALASKA, AUTHORIZIG TIDE CITY MANAGER TO ACCEPT THE
ALASKA HIGHAY SAFETY OFFICE HIGHWAY SAFETY GRANT IN THE
AMOUNT OF $17,960 FOR T'~E PURCHASE OF A "ItADAR/MESSAGE
TRAILER"
WHEREAS, the Seward Police Department has been awarded the Alaska Highway Safety
Office, Highway Safety Grant in the amount of $17,960.00; and
WHEREAS, the Grant Agreement requires Council acceptance; and
WHEREAS, there are no matching funds to accept this grant; and
WHEREAS, these funds will be used to purchase "Radar/Message Trailer"; and
WHEREAS, the Police Department wishes to reduce the incidents of speeding violations in
the Seward; and
WHEREAS, the preliminary part of the program is to show the public how fast they are
actually traveling and encourage them to travel the posted speed limit.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA that:
Section 1. The City of Seward accepts the Alaska Highway Safety Office Highway Safety
grant in the amount of $17,960.00 from State grant account no. 101-0000-4680-0200 to fund the
purchase of a "Radar/Message Trailer" t~ account no. 101-1210-5930 and proceeding with this
project on October 1, 2008.
Section 2. This resolution shall take effect immediately upon adoption.

The Alaska Highway Safety Office (AHSO) is pleased to approve the "Radar/Message
Trailer" grant application with federal fiscal funds in the amount of $i~,96o.00. This
letter serves as your notice to proceed beginning October i, 2008. Your agency was
selected for these funds because data-driven recognized projects like this one save lives
on Alaska's highways.
A "Notice To Proceed (NTP)" form will be faxed to your office during October, the first
month of the federal fiscal year.
Due to congressional Continuing Resolutions (CR), which provides these transportation
funds in incremental amounts, we will start processing the FFYo9 NTP's in October on a
quarterly basis. Therefore, your first grant award and Notice To Proceed amount will be
for the grant activities which occur between October i, 2008 through December 3i,
2008. You will receive a quarterly grant award and a Notice to Proceed before each
quarter, usually via fax. The second quarter is January ~-March 3i, 2009, the third
quarter is April i-June 30, 2009 and the fourth quarter is July ~-September 30, 2009.
We cannot reimburse for any charges prior to the Notice To Proceed dates. In order to
be reimbursed for your expenditures, we must receive the reimbursement claims on a
monthly basis, along with all supporting documentation (i.e. receipts, documentation of
match, etc.) as well as the reports quarterly.
We must receive the completed annual evaluation and final reimbursement claim by
Monday, October 19, 2009. Upon review and approval of the documents, we will
process the reimbursement and send you a check. Please review the reporting forms
before the project begins so you'll understand what we need to have when the project is
completed.

RESOLUTION 2008-094
WHEREAS, the Police Department will have the ability to access backup documentation of
fingerprints easily and quickly when necessary and to provide quality assurance that can be
accomplished in house; and
WHEREAS, The State of Alaska has deployed the Crossmatch Livescan systems in six DOC
facilities, and Valdez, Cordova, Homer and Sitka Police Departments have all purchased live scans
off of the State contract; and
WHEREAS, The State of Alaska currently has contracted with Crossmatch technologies for
their Livescan fingerprinting equipment; and
WHEREAS, Crossmatch had to comply with the electronic transmission of criminal or
criminal justice employment applicants to the State of Alaska (and through them to the FBI), they
had to meet their system requirements such as SMTP transmission of fingerprints that must be
captured at least 1000 ppi and the Crossmatch contract allows users to interface with APSIN and/or
OTIS to pull down person specific information to populate the fingerprint card.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA that:
Section 1. Authorize the City Manager to enter into a sole source purchase in the amount
not-to-exceed $19,105.88 for the purchase of a "LSCAN l OOOTvS Live Scan Fingerprint System,
and utilizing funds from existing police department budget.
Section 2. This resolution shall take affect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 22nd day of
September, 2008.

captured at least 1000 ppi. Also, the Crossmatch contract allows users to interface with

4. The State of Alaska would not authorize this interface with a different live scan company.

Restrictions and provisions of this title shall not apply where the city council determines and
makes written findings that the public interest would be best served by not requiring
competitive bids/proposals.
Suaporting Justification:
ProComm is Motorola's authorized distributor, installer and maintainer in Alaska. The contract includes
professional services (engineering). The federal funds grant was awarded through the Office of Homeland
Security based on grant request as specified, award contains specified equipment. ProComm Alaska is a
state contractor with a local office, and the City of Seward `would benefit from the State discount price
schedule. Management of this project is the responsibility of the City of Seward and not the contractor.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, APPROPRIATING $500,000 TO THE HOSPITAL OPERATIONS
RESERVE ACCOUNT, TO COVER ANTICIPATED CASH FLOW LOSSES
OFTHE CO-LOCATED HOSPITAL AND LONG-TERM CARE FACILITIES
WHEREAS, the City of Seward owns a hospital and is in the process of constructing a long-
term care facility, both of which are to be managed and operated by Providence Health & Services
under agreement with the City; and
WHEREAS, because long-term care operations are currently being conducted in a facility
that has reached the end of its useful life, significantly reducing the capital cost reimbursements
previously depended on to maintain positive cash flow at the co-located hospital and long-term care
facility; and
WHEREAS, these short-term losses were predicted in the pro forma financial statements
presented to the public and to the Seward City Council prior to making the decision to enter the long-
term care business, with total losses projected to be nearly $1 million per year; and
WHEREAS, despite a nearly two-year delay in construction of the facility, financial losses in
the 18 months since rate rebasing have resulted in cash flow losses of less than $1 million through
December 31, 2008; and
WHEREAS, the Seward City Council approved Resolution 2008-088 on September 8, 2008,
authorizing the depletion of former reserves available to cover short-term financial losses, and the
newly authorized contract with Providence requires that the City be able to cover cash flow
shortages, necessitating a reservation of fund balance for that purpose; and
WHEREAS, this resolution will enable the administration to reimburse Providence for cash
flow shortages which they are currently covering, for shortfalls occurring through the end of 2008.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA that:
Section 1. The amount of $500,000 is hereby appropriated from undesignated fund balance
account no. 101-0000-3050 to the Designated for Hospital Operations account no. 101-0000-3042-
0003.
Section 2. The City Manager is hereby authorized to spend up to $500,000 from the
Designated for Hospital Operations account, to the Hospital pass-through account no. 101-1191-
- 5998, to reimburse Providence for cash flow losses.

BACKGROUND & JUSTIFICATION:
The City is currently constructing a new long-term care facility to replace the existing privately-
owned facility. Because the current long-term care facility has reached the end of its useful life, the
reimbursement rates from Medicaid have been significantly reduced. This is a short-term financial
problem which was clearly understood by the City Council and the community prior to the City's
decision to enter the business of providing long-term care services.
In the long-term, the co-located hospital and long-term care facility is expected to operate in a
positive cash position. However, in the short-term, the City anticipates operating losses less than
$600,000 per year beginning in January, 2007, until the facility opens its doors. This equates to
approximately 50% of the original estimated losses, and is due to cost containment by the Providence
management team, as well as to the renegotiation of management fees in the recently-approved
management agreement.
Since January, 2007, the hospital has experienced operating losses totaling approximately $650,000.
The City Council appropriated $500,000 to cover these losses on September 8, 2008. This resolution
replenishes the operating loss account, and allows the city manager to draw from this account to
cover operating losses between now and the end of the year, as required by the new management
contract with Providence.

WHEREAS, the purchase of additional properties and/or rights-of--way necessary for the
project will be brought before Council for a subsequent authorization once property appraisals are
complete.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA that:
Section 1. The amount of $695,000 is hereby appropriated from State legislative grant funds
account no. 666-6662-4680-0200, to pass through account no. 666-6662-5998.
Section 2. The City Manager is hereby authorized to negotiate for the acquisition of nine
parcels according to the map attached hereto, in accordance with Council direction as provided in an
executive session, and subject to final Council approval and to receipt of all necessary project
permits.
Section 3. The City Manager is hereby authorized to facilitate - subject to final City Council
approval, and subject to the receipt of all necessary project permits -- either the direct purchase of
properties and their placement in a conservation easement, or alternatively, to transfer funding to a
non-profit entity authorized by the Army Corps, subject to that entity's written agreement to purchase
the identified properties, place them into a conservation easement, and manage the properties for
conservation purposes, in perpetuity.
Section 4. The City Manager is hereby authorized to satisfy the requirements of the Japanese
Creek levee project mitigation plan, in conjunction with the Army Corps, to include compensating
for impacts to fish habitat and facilitating mitigation and conservation efforts.
Section 5. This resolution shall take affect immediately upon its adoption.

Revised Mitigation Plan
September 16, 2008
The following avoidance, minimization, and mitigation measures will be followed for impacts to
wetlands. A monitoring plan would be drafted and followed to ensure that mitigation is
conducted during and following construction.
• Staking will be done along the levee/road footprint prior to construction to ensure that
disturbance impacts are limited to that area.
• The clearing limit will extend only to 10 feet beyond the structural fill in order to place
excavated fine grain material on the levee/road slope. The fine grained material will
minimize hydraulic conductivity through the levee.
• Temporary impacts to wetlands will be minimized during design by limiting staging areas in
wetlands.
• Where work extends beyond the clearing limits, temporary impacts to wetlands will be
minimized by working off mats or timbers in these locations.
• Only clean fill material will be used for the levee/road embankment to limit sediment laden
runoff into Japanese Creek, Resurrection River, and adjacent wetlands.
• To limit embankment erosion and down gradient sedimentation, Best Management
Practices regarding erosion and sedimentation control will be employed during construction
and permanent measures will be employed as early in construction as possible. These
BMPs include, but are not limited to:
o Prior to fill placement, a silt fence or similar structure will be installed on a line
parallel to and within 5 foot of the proposed fill toe of slope within all wetland
areas that contain standing water that is connected to any natural body of water
or where the fill toe is within 25 feet of such a water body. This structure will
remain in place until the fill has been stabilized or contained in another manner.
(Silt fences will be installed if the construction activity is occurring during the
time that the water is in a frozen state.)
o Bank cuts, slope, fill, bottoms of road side ditches, and exposed earth work,
especially levee construction and road building activities, will be stabilized to
prevent erosion both during and after project construction.
o Silt fences or other appropriate methods will be employed, as necessary, to filter
or settle sediment runoff. Silt fences or other structures will be maintained until
disturbed or deposited material has been stabilized against erosion.
o A vegetated swale will be constructed down slope on the protected (non flood)
side of the paved levee/road to trap sediment.
o Native grass seed will be placed on slopes on the protected (non flood) side of
the levee/road to prevent the erosion of fine-grained material from the slopes
and into the adjacent wetlands. Topsoil will be applied to the surface of slopes
to aid in the reseeding process.

on several projects including sludge piles and the lagoon at SMIC, lead and copper testing of town
and SMIC, Cedar to Ash Street sewer lime and paving, and flushing of sewers.
Parks and Recreation was painting bathrooms, the Hoben Park Fountain was completed, and
Sports and Rec was busy with leagues, tournaments, and various community events.
In other areas, the final price of the Long Term Care Facility construction was $21 million
and change, which was down $2.3 million from the Unit Company bid, as directed by the council.
Oates thanked Frank Dahl and The Pit Bar for their many contributions and fundraisers in the last
year. The City of Seward received their recertification as a Tsunami Ready community along with
attaining the Storm Ready designation. Informational sheets on the two ballot propositions went out
in utility bills this week as well as online. Oates met with the Chamber to discuss these initiatives
and the efficiency study. Council had conducted two work: sessions on the efficiency study, and
more were to come. Oates hoped to get through these issues before the budget time.
City Attorney's Report. Cheryi Brooking stated the attorneys gave advice nn taxes and
fees, proposed contracts, resolutions, ordinances, adminstrati~ e matters, employment issues, ballot
and voter qualification issues, aspects of the proposed levee project, options to extend leases, lease
amendments, and provided information on flood management. With regard to the Small Boat
Harbor and SMIC, the attorneys provided assi stance with various hay°bar and SMIC land use matters
such as harbor compliance, environmental issues, leases and contracts. The attorneys continued with
on going mediation and settlement discussions ~~~ith the Resurrection Bay Conservation Alliance
lawsuit.
Port and Commerce :advisory Board Report. Ron Long stated the board passed a
resolution to come forward ro c~conimend a zoning district and potential uses for south harbor
uplands. The board thought it best to be less restrictive in the uses allowed and many possibilities
were suggested. He wele~med-Mari Anderson as an ex officio member of the PACAB and mourned

Florida from January of 2003 as Executive Assistant to the Cit~nager and HR Officer
and then HR Officer and City Clerk from March 2003 to May 2006 I received my City
Clerk Certification in 2004, I attended FEMA Integrated Emergenc~Mana eg_ment
Courses in All Hazards in 2001. I have held a Professional Human Resource certificate
and have a current CDL. Served on the Seward Job Center Advisory Board, Providence
Health Council Advisory Board, Kenai Peninsula Borough School District Site Based
Council, Little League Board and the East Kenai Peninsula Borough Road Maintenance
Board.
