OPENING CEREMONY Council Member Tom Smith led the pledge of allegiance to the flag. ROLL CALL There were present Mayor Clark Corbridge presiding and Jean Bardarson Bob Valdatta Marianna Keil Betsy Kellar Tom Smith Willard Dunham comprising a quorum of the Council; and Phillip Oates, City Manager Jean Lewis, City Clerk Cheryl Brooking, City Atton~ey Kari Anderson, Harbormaster Jim Lewis, Deputy Harbormaster ABSENT - Nonc CITIZENS' COMMENTS ON ANY SUBJECT EXCEPT THOS1: ITEMS SCHEDULED FOR PUBLIC HEARING -None APPROVAL OF AGENDA Motion (Kell/Bardarson) Motion Passed NEW BUSINESS EXECUTIVE SESSION Motion (Bardarson/Keil) Approval of Agenda Unanimous Go Into Executive Session To Discuss Possible Litigation With Seward Ships Drydock In Regards To Their Maintenance And Operating Agreement. 1Vlotion Passed Unanimous City of Seward, Alaska Mcn~ch L0. 2009 Ciry Council Miniver Voharre 38. Page 35 Went into executive session at 5:34 p.m. Came out of executive session at 7:35 p.m. Motion (CorbridgelSmith) Instruct the City Manager regarding possible litigation with Seward Ships Drydock in regards to their maintenance and operating (M&O) agreement. The City Council finds them in default of the M&O agreement. We authorize the city manager to list the discussed defects and conditions, in whatever detail he deems appropriate. If defects that have been discussed are corrected, the council is willing to discuss negotiation of a successor M&O agreement. If conditions, requirements and deadlines as set out by the city manager fail to be met, council will proceed to terminate the M&O agreement because of default Within 30 days thereafter, the council will act to terminate their ground lease. Motion Passed Unanimous Mayor Corbridge notes for the record that the motion passed unanimously. COUNCIL COMMENTS Dunham stated the bill on changing from daylight savings time will be heard on 8:00 am this Thursday. He also stated the airfare to Korea was approximately $1,300. Dunham was thinking about attending the'furtle Ship Festival in Korea. Oates stated employee Mike Meeks would like to go to Korea at his own expense if a delegation from the city went. CITIZENS' COMMENTS Deputy Harbormaster Jim Lewis offered to make copies which explained the load monitoring system from the Synchrolift Maintenance Manual for Councihnember Smith.
