C[TY MANAGER TO ENTER INTO A CONTRACT WITH FIARMON CONSTRUCTION FOR THE CONSTRUCTION OF THE ADAMS STREET WATERFRONT PAVILION FOR $312,000, PLUS AUTHORIZING ADDITIONAL PROJECT-RELATED COSTS OF $33,000, AND APPROPRIATING FUNDS WHEREAS, the Seward community has been eager to replace the Wellington pavilion and Adams Street pavilion which were demolished in 2003 after an engineering assessment determined the two structures were overstressed acid posed a potential hazard to the public; and WHEREAS, the pavilion design was modeled after the historic Seward Depot located along Railway Avenue and Fourth Street and the concept was approved by the City Council on June 26, 2006 by Resolution 2006-09; and WHEREAS, a bid for construction for new ocean side pavilions to replace the structures at both Adams Street and Ballaine and D Street and Ballaine was advertised on July 13, 2006 and again on July 20, 2006 in both the Anchorage Daily News and the Seward Phoenix Log; and .._ WHEREAS, thirteen bid packages were sent out and one bid was submitted on August 10, 2006 by Swenson Construction, which is the former business name for the entity cun~ently doing business as Harnion Construction; and WHEREAS, on December 1 1, 2006 Resolution 2006-98 authorizing the City Manager to enter into a contract with Swenson Construction for the construction of one waterfront pavilion in an amount not to exceed 5397,000 and appropriating foods was postponed indefinitely; and WH F,RF.AS, on February 20, 2009 Hannon Construction has submitted a revised proposal to the City for value engineering the Adams Street pavilion which maintains the overall appearance of the pavilion much the same as the original bid submitted in August 2006; and WHEREAS, working with City staff, value engineering the project and with the help of volunteers provided by the City, Harmon Construction has substantially reduced the cost of the Adams Street pavilion; and WHEREAS, landscaping, painting, installation of bench and picnic tables, rock facade on barbeque, handicap walkway and other work will he completed by volunteers, staff and City of Seward equipment; and CITY OF SEWARD, ALASKA RF,SOLUTION 2009-020 WHEREAS, on March 23, 2009 Council passed Resolution 2009-016, Authorizing the City Manager to Negotiate a Contract with Harmon Construction for The Construction of the Adams Street Waterfront Pavilion for $312,000, Plus Authorizing Additional Project Related Costs of $33,000, and Appropriating Funds; and WHEREAS, the City of Seward has $195,000 from the State of Alaska and a written commitment of $150,000 from the Alaska SeaLife Center Waterfront Development Fund contingent on public involvement to build the pavilion; and WHERF,AS, there is a contingency of $7,000 for electrical work and if implemented will come out of the $33,000 designated for additional project-related costs. NO~V, THEREFORE,, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SF,WARD, ALASKA, that: Section 1. The City Manager is hereby authorized to enter into a contract with Harmon Construction for the constniction the Adams Street waterfront pavilion in the amount of 5312,000. Section 2. The City Council hereby authorizes an additional expenditure of 533,000 which can he used for the purchase of materials, supplies, volunteer insurance, utilities, and other costs associated with the pavilion project, to include possible change orders to the contract with Harnton Construction, which must be approved in advance at the sole discretion of the City Manager. Section 3. Funding in the amount of $345,000 is hereby appropriated as follows: 1) 5195,000 from State grant funds accoturt no. 811-8110-4680-0200; and 2) $150,000 from Other grant funds account no. 81 1-81 10-4680-0900 to account for proceeds from a grant from the Alaska Sealife Center, for a total of $345,000 in project costs allocated as follows: 3) $312,000 to infrastnicture account no. 811-8110-592; and $33,000 to materials and supplies and contracted services account no. 81 1-81 10-5440/5390 for materials and labor. Section 4. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the City of Seward, Alaska, this 27`n day March, 2009. On March 23, 2009 Council approved Resolution 2009-016, Authorizing the City Manager to Negotiate a Contract with Harmon Constructive for the Constnrction of the Adams Street Waterfront. Pavilion for $312,000, Plus Authorizing Additional Project-Related Costs of $33,000, and Appropriating Funds. Harniou Cvnstruction had submitted a final proposal of X312,000 which incorporates volunteers' assistance, provided by the City, in the build. Volunteers v`~ill be utilized for tasks such as painting of the T&G boards for the ceiling, the trim around the walls/windows, and pre-installation of structural members. Other areas for volunteer assistance are brick work for the fireplace, picnic tables, electrical work for interior lights and landscaping. The $33,000 designated for additional project-related costs can be used for the purchase of materials, supplies, volunteer insurance, utilities, and other costs associated with the pavilion project, to include possible change orders to the contract with Harmon Construction, which must be approved in advance at the sole discretion of the City Manager. The Contractor covenants and agrees that its work on the project will be substantially completed on or before: July 2, 2009. The Contractor further cvvenants and agrees that all materials shall be furnished and delivered and all work and labor shall be done and performed. in every respect, to the satisfaction of the City, on or before: July 17, 2009. CONSISTENCY CHECKLIST: Where applicable, this agenda statement is consistent with the Seward City Code, Charter, Comprehensive Plans, Land Use Plans, Strategic Plan and City Council Rules of Procedures.
