ADJOURNMENT City of Seward, Alaska PA CAB Agenda September 21, 2011 Page 2 Sponsored by: Board CITY OF SEWARD, ALASKA PORT AND COMMERCE ADVISORY BOARD RESOLUTION 2011-07 A RESOLUTION OF THE PORT AND COMMERCE ADVISORY BOARD, RECOMMENDING THE CITY OF SEWARD AMEND THE PORT AND HARBOR TARIFF REGULATIONS EFFECTIVE JANUARY 1, 2012 WHEREAS, the Seward City Council will review all enterprise fund tariffs in preparation for drafting the 2012 and 2013 budgets; and WHEREAS, the City Administration has outlined critical capital replacement needs for the Seward Harbor and identified the required bond payments for 2012 and 2013; and WHEREAS, the proposed changes will not fund all capital replacement needs, however they will assist in covering the operating costs of the harbor and allow a higher percentage of the shared fisheries business tax to fund the Major Repair and Replacement Fund, WHEREAS, the City of Seward's enterprise funds are operated in a manner similar to private business entities, in that they establish charges intended to cover the full cost of providing services including operations and maintenance, overhead, system expansion, utilities, and charges for the use of capital facilities; and WHEREAS, the public has expressed the desire to simplify the electric rate structure by combining electric fees into a flat kilowatt hour rate to encompass charges such as connect fees, fuel adjustment factors, and the kilowatt hour rate; and WHEREAS, due to the need to regularly review and update charges to account for the impact of inflation and other cost increases, it is prudent to update charges annually. NOW THEREFORE, BE IT RESOLVED by the Port & Commerce Advisory Board that: Section 1. The rates, fees, and charges incorporated herein by reference and attached hereto as "The Port and Harbor Tariff Regulations- 2012" are recommended for council adoption to become effective January 1, 2012. AGENDA STATEMENT Reviewed again on: September 21, 2011 Originally introduced: August 3, 2011 To: Port and Commerce Advisory Board From: Seward Harbormaster Subject: Changes to the 2012 Port & Harbor Tariff Regulations, affecting 2012-13 Harbor Enterprise Fund Budget BACKGROUND & JUSTIFICATION: Public meetings were held on June 6th and July 61h presenting the Capital needs of the Harbor Enterprise Fund. These meetings outlined capital requirements including the replacement of D float, maintenance dredging, and maintaining used oil stations. At the end of these presentations, a listing of Administrations recommendations was provided to address changes in the Port & Harbor Tariff Regulations affecting the 2012-2013 Budget. A summary of these recommendations is listed below. Recommendations for Changes to the Port & Harbor Tariff: Continue to link Tenant/Slip-Holder moorage rates to the CPI ■ 2012 = 2.86% increase ■ 2013 = 2.6% increase Increase the Transient/Guest Moorage Rates by 10% ■ Would generate $40,000450,000 additional revenue ■ Rates would be less than Homer, Whittier, Kodiak, Valdez, Cordova ■ 2012 = $0.66 per foot per day ■ 2013 = $0.68 per foot per day Eliminate Quarterly Rates Moorage Rates available for Annual, Semi -Annual, Monthly or Daily timeframes. Subsection 205 (d) (4) Eliminate Miscellaneous Electric Charges for Reconnection Eliminate reconnection to approved existing meter installation during regular business hours and/or outside regular business hours. Subsection 225 (e) (2) & (3) Restructure Harbor Electric Fees Establish a per kilowatt hour charge that would include the fuel adjustment factor and revenue formerly generated by connect fees, so these are not additional fees that must be charged. All vessels (except Transient staying 15 days or less) will pay a per kilowatt hour charge as established in the tariff and a monthly customer charge. Subsection 225 (a) (2) (i) SMIC Electric Charges $15.75 Customer Charge does not cover fees charged by Electric Department. This fee should be increased. Subsection 225 (a) (3) (iii) These changes will not fund all capital requirement needs, however they will 1.) assist in covering operating costs of the harbor and 2.) provide a clearer and more customer -friendly mechanism for billing for electrical use in the harbor. In 2010, the City received $302,261.97 of Shared Fisheries Business Tax. However, only $143,501 was transferred into the Major Repair and Replacement Fund, and the remainder was utilized to cover the operating costs of the Harbor Enterprise fund. The City has made cuts to the Harbor Enterprise Fund operating budget over last three years, however it is impossible to cut operational costs and expenses such as heating fuel, bond payments, and electricity. There is no more "fat to trim" in the harbor without reducing services. The harbor has increasing costs in areas just as private industry: utilities, processing used anti- freeze, waster services, and workers compensation insurance. Operational costs including: maintenance and repair, postage, insurance, small tools and equipment, and contracted services can not be further reduced to operate a harbor of this size with 670 slips, 4,000+ linear feet of transient moorage, 500+ power pedestals. The operational budget for these expenses has decreased to a point where the harbor simply cannot operate with less. One alternative to passing these changes/increases would be to cut services. Reducing staff would limit the days of the week that Travelift services would be offered, and the evening coverage by seasonal summer staff would be eliminated. Other possible alternatives could be increasing passenger fees, Travelift fees, or launch ramp and wait list fees. The harbormaster shall have the authority to manage the secondary distribution system serving shore power to vessel slip leaseholders. The management will also include meter reading, billing, and the collection of fees for service connects and disconnects. (b) Availability. All permanent vessels mooring at slips having electrical power shall connect and pay the subject fees established by resolution of the Seward city council. (c) Shore power. Every effort shall be made by the harbormaster's office to provide "shore power" to those transient vessels who require such service. A deposit and a daily flat rate for power used, as established by resolution of the Seward city council, shall be charged. (d) Type of service. Single-phase, 120/208 voltage, 30 amp outlets shall be provided. Interconnection to Customer -Owned Alternate Technology and Fossil Fuel Standby Generation Equipment 14.15.410. Alternate technology generation. (a) The city will permit the interconnection and operation of alternate technology generation facilities such as wind energy conversion systems or small scale hydroelectric facilities with its integrated distribution system upon compliance by the customer with the following provisions: (1) A customer who owns any alternate technology generation shall request approval from the city to interconnect with its system at least three months prior to the date on which the customer intends to make any connection in any way to the electric circuitry common to the city's integrated distribution system. (2) The customer shall submit to the city along with his request for interconnection complete documentation of alternate technology generation equipment including but not limited to: schematics; wiring diagrams; performance specifications; descriptions of energy storage devices, circuit protection equipment, regulation equipment, automatic disconnect equipment, and any other proprietary device provided by the equipment manufacturers. (3) Upon approval of the interconnection by the city, the customer shall agree under special contract with the city to pay the cost of any special metering equipment or circuit modifications determined by the city as necessary to accomplish the interconnection; to install power factor corrective equipment as necessary to maintain a power factor of not less than 0.9; to operate the generation equipment in strict compliance with safety procedures established by the city, and to accept the terms of purchase of energy or capacity or both as set forth in the contract. Minutes August 3, 2011 Volume, Page CALL TO ORDER The August 3, 2011 rescheduled regular meeting of the Port and Commerce Advisory Board was called to order at 12:07 p.m. by Ron Long, Chair. OPENING CEREMONY Chair Long led the pledge of allegiance to the flag. Harbor A municipal Harbor matching grant was submitted to Department of Transportation; Ports and Harbors division for consideration. The grant was dependent on state funding and would upgrade float if awarded. Seward Silver salmon derby was drawing near and harbor personnel were busy preparing for it. Construction of the Harbor Mariners memorial was scheduled to begin with a ground breaking event in the near future. Private businesses that had been experiencing difficulty loading kayaks and other shore loading had been allocated about 60 feet of space along X float (seasonally). Electronic cash and credit card payment stations had been installed at the top of the ramps to take the place of the old inefficient manual system. City administration had met with Northern Economics, Coastal Villages Region Fund Representatives and the Alaska Industrial Development and Export authority to look at the economic analysis and feasibility study for enclosing the SMCI basin. An RFP had been released by the City for engineering services for the same. The Harbormaster announced her resignation to the board, effective September 2, 2011. City of Seward, Alaska Port and Commerce Advisory Board Minutes August 3, 2011 Volume Page Administration Report — Michelle Weston An aggressive timeline had been set and followed for the RFP for the SMIC basin and the project was moving forward quickly. Alaska Business monthly was with the packets, the Board was directed to a Seward Article there in. September 7th Legislative visit and schedule reviewed. The RFP process was generally discussed by the board, harbormaster and Ms. Weston. Chamber report- Cindy Clock Derby was beginning the following week. Sponsorship and advertising was going well for the derby. CITIZENS' COMMENTS ON ANY SUBJECT EXCEPT THOSE ITEMS SCHEDULED FOR PUBLIC HEARING There were none. APPROVAL OF AGENDA AND CONSENT AGENDA Motion (Altermatt/Schaefermeyer) Approval of Agenda Unanimous Consent Motion Passed Motion (Schaefermeyer/Jaffa) Approve resolution 2011-XX of the Port and Commerce Advisory Board, Recommending the City of Seward Amend the Port and Harbor Tariff regulations effective January 1, 2012 General discussion of the resolution and suggested changes: Including the tariff rate structure, differences in the SMIC rates vs. harbor rates, infrastructure condition and improvements, different titles for `fees', flat rates, transient vessels, capital improvements, attracting customer and new businesses, comparative rates with like sized harbors, and Seward's billing and utility process. The board requested more information to move forward with a recommendation on the tariff changes. Vote on Motion Tabled resolution indefinitely pending more information. Unanimously BOARD COMMENTS Chair Long and then the board each individually expressed thanks to Harbormaster Andersen for her work over the last 2 years in the harbor. The board wished her luck in her future endeavors.
