PROCLAMATION
WHEREAS, City of Seward Fire Chief and Building Official David Squires has
served the community for 28 years; and
WHEREAS, during that time Mr. Squires has been committed to assisting the
Seward Planning and Zoning Commission and the Community Development Department
with numerous land use and development issues; and
WHEREAS, Mr. Squires has been instrumental in crafting City Code requirements
for the Building Department and the Community Development Department, as well as
providing thoughtful and valuable comment and insight to the Planning and Zoning
Commission; and
WHEREAS, Mr. Squires retired from the City of Seward on May 31, 2013.
NOW THEREFORE, I, Sandie Roach', Chair of the City of Seward Planning and
Zoning Commission do hereby award this Commitment to Planning Award to
David Squires
and urge all citizens to show their gratitude for the contributions Mr. Squires has made
to the community.

A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF

THE CITY OF SEWARD, ALASKA, RECOMMENDING CITY COUNCIL
AMEND PORTIONS OF SEWARD CITY CODE 15.25 FLOODPLAIN
MANAGEMENT TO ADOPT THE SEPTEMBER 27, 2013 DIGITAL
FLOODPLAIN RATE MAPS AS ESTABLISHED BY FEMA AND
UPDATE PORTIONS OF TITLE 15.25 TO MINIMUM FEMA
REQUIREMENTS
WHEREAS, City Council adopted Ordinance 98 -11 in November 1998, establishing
Title 15.25 Floodplain Management of the Seward City Code; and
WHEREAS, City Council adopted Resolution 98 -127 authorizing the participation in the
National Flood Insurance Program (NFIP); and
WHEREAS, the Federal Insurance Administration has provided Digital Flood Insurance
Rate Maps (DFIRM) and the Federal Insurance Study (FIS) affective September 27, 2013; and
WHEREAS, both the City of Seward and the Seward Bear Creek Flood Service Area
(SBCFSA) have held several public meetings and work sessions in review of the DFIRMs; and
WHEREAS, the Federal Insurance Administration issued the letter of final
determination on March 27, 2013; thereby setting a six month adoption date of September 27,
2013; and
WHEREAS, the Public Hearing notification process has been complied with.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Commission recommends Council approve the attached Ordinance 2013-
_, adopting the Digital Flood Insurance Rate Maps (DFIRM) and the Federal Insurance Study
(FIS) affective September 27, 2013.
Section 2. The Commission further recommends the Council approve the attached
Ordinance 2013- , amending various portions of Title 15.25. Floodplain Management to meet
minimum floodplain management requirements as provided by FEMA.

FEMA AND UPDATE PORTIONS OF TITLE 15.25 TO MINIMUM FEMA
REQUIREMENTS
WHEREAS, City Council adopted Ordinance 98 -11 in November 1998, establishing
Title 15.25 Floodplain Management of the Seward City Code; and
WHEREAS, City Council adopted Resolution 98 -127 authorizing the participation in the
National Flood Insurance Program (NFIP); and
WHEREAS, the Federal Emergency Management Administration (FEMA) has worked
to digitize the local 1981 Floodplain Rate Maps (FIRM) and update the Flood Insurance Study
(FIS) since January 2006; and
WHEREAS, both the City of Seward and Seward Bear Creek Flood Service Area
(SBCFSA) have held numerous public meetings and work sessions in discussion and review of
the DFIRMs; and
WHEREAS, the Federal Insurance Administration issued the letter of final
determination on March 27, 2013; thereby setting a mandatory six month adoption date of
September 27, 2013; and
WHEREAS, Title 15.25 Floodplain Management, of the City Code has not been updated
since it was established in 1998; and
WHEREAS, with the Federal Insurance Administration, September 27, 2013 DFIRM
adoption, Seward City Code requires updating to remain eligible for the National Insurance Rate
Program; and
WHEREAS, at its June 4, 2013 meeting, the Planning and Zoning Commission held a
public hearing and recommended City Council approval of the proposed City Code amendments,
including the adoption of the DFIRMs and the FIS dated September 27, 2013.
NOW, THEREFORE, THE CITY OF SEWARD ORDAINS that:

Title 15.10.140 is hereby amended as follows:

15.25.020. - Definitions
Development means any manmade change to improved or unimproved real estate,
including but not limited to buildings or other structures, mining, dredging, filling,
grading, paving, excavation, or drilling operations or storage of equipment or
materials (note: add this per 44 CFR 59.1) located within the area of special flood hazard.
Substantial damage means damage of any origin sustained by a structure
whereby the cost of restoring the structure to its before damaged conditions would
equal or exceed 50 percent of the market value of the structure before the damage
occurred. (note: add this per 44 CFR 59.1)
15.25.030. - General provisions

The areas of special flood hazard identified by the Federal Insurance
Administration in a scientific and engineering report entitled "The Flood
Insurance Study (FIS) for the Kenai Peninsula Borough, Alaska and
Incorporated Areas (City of Seward), dated September 27, 2013, with
accompanying Flood Insurance Rate Map (FIRM) are hereby adopted by
reference and declared to be a part of this ordinance. The Flood Insurance
Study (FIS) and Flood Insurance Rate Map (FIRM) are on file at the
Community Development Office.
15.25.050. - Provisions for flood hazard reduction
(A.) General standards. In all flood hazard areas, the following standards are
required.
(4) Subdivision proposals
d. Where base flood elevation data has not been provided or is
not available from another authoritative source, it shall be
generated for subdivision proposals which contain 50 lots or five
acres, (note: remove and replace with required language 44 CFR
60.3(b) (3)) whichever is less.

(B) Specific standards. In all flood hazard areas where base flood elevation
data has been provided as set forth in section 15.25.030(b), the following
provisions are required:
(1) Residential construction
c. For zones All and AO, drainage paths are required
around structures on slopes to drain floodwaters away from
proposed structures. (note: add this per 44 CFR 60.3 (c) (11))
(2) Nonresidential construction
f. For zones All and AO, drainage paths are required
around structures on slopes to drain floodwaters away from
proposed structures. (note: add this per 60.3 (c) (11))
(3) Manufactured homes
a. When in an existing manufactured home park, for any
new or substantially improved manufactured home its chassis
shall be supported by reinforced piers or other foundation
elements of at least equivalent strength that are no less than 36
inches above grade and be securely anchored so as to resist
flotation, collapse, and lateral movement. (note: add this per 60.3 (c)
(12))
(4) Recreational Vehicles. For any recreational vehicle placed on
sites within Zones Al — A30, AH, and AE, it must be on site less than
180 consecutive days, or be fully licensed and ready for highway use
or meet the requirements of section 15.25.050 (A)(1) through (5) and
section 15.25.050 (B)(1) through (3). A recreational vehicle is ready for
highway use if it is on its wheels or jacking system, is attached to the
site only by quick disconnect type utilities and has no permanently
attached additions. (note: add this per 60.3 (c) (14))
(D) Coastal high hazard areas
(4) The use of fill for structural support of buildings within Zones VE
V1-V30 V on the FIRM is prohibited. (note: add this per 60.3 (e) (6))
(5) For any recreational vehicle placed on sites within Zones V1—
V30, V, and VE, it must be on the site less than 180 consecutive days.,
or be fully licensed and ready for highway use, or meet the
requirements of section 15.25.050 (A)(1) through (5) and section
15.25.050 (B)(1) through (3). A recreational vehicle is ready for

(DFIRM) and the Flood Insurance Study (FIS) Dated September 27,
2013
BACKGROUND AND JUSTIFICATION:
In January 2006 the Federal Emergency Management Administration (FEMA) started work to
modernize the 1981 Floodplain Rate Maps (FIRM) and the Flood Insurance Study (FIS). Since that
time City staff and the Seward Bear Creek Flood Service Area Board (SBCFSA) have held numerous
meetings and teleconferences with FEMA regarding the program to modernize the flood maps by
digitizing the old 1981 maps.
While it is well known that the 1981 FIRMs needed to be corrected and the Seward flood area re-
studied and remapped; the federal government did not fund such a program. What was funded was
the modernization of the 1981 FIRMs by digitizing them. There were some updates done such as
adding the area of Fourth of July Creek and a few minor corrections made.
In November of 1998 City Council adopted Ordinance 98 -11 establishing Title 15.25 Floodplain
Management of the Seward City Code. City Council also adopted Resolution 98 -127 authorizing the
participation in the National Flood Insurance Program (NFIP). Since 1998 the City has been
managing the floodplain based on the 1981 FIRMs.
On March 27, 2013 the Federal Insurance Administration issued the letter of final determination on
the DFIRMs. Once the letter of final determination has been issued the City has six (6) months to
officially adopt the maps. If the City were to choose to not adopt the maps the City would be
removed from the NFIP and become ineligible for federal funding. Over the past 15 years the
Federal Insurance Administration has issued changes to the minimum code compliance requirements.
The City has made no updates or amendments to the City Code title 15.25 Floodplain Management
since the original adoption in 1998.

Seward City Code§ 15.01.035(c)(2) &(3) provides that the Planning and Zoning Commission shall
hold a public hearing and forward written recommendations to the City Council before the City
Council amends or repeals any land use regulations, or changes zoning or land use boundaries.
As per City Code § 15.01.040 Public Hearings; the public notice requirements were met. At the time
of publishing this agenda, no further public inquiry had been received.

RECOMMENDATION:
Staff recommends the Commission approve Resolution 2013 -12, recommending the City Council
enact the attached Ordinance adopting the September 27, 2013 Digital Floodplain Insurance Rate
Maps and updating the Seward City Floodplain Management Code to the minimum Federal
Insurance Administration requirements.

Subpart A— General
§ 59.2 Description of program.
(a) The National Flood Insurance Act of 1968 was enacted by title XIII of the Housing and Urban
Development Act of 1968 (Pub. L. 90 -448, August 1, 1968) to provide previously unavailable flood
insurance protection to property owners in flood -prone areas. Mudslide (as defined in § 59.1)
protection was added to the Program by the Housing and Urban Development Act of 1969 (Pub. L. 91-
152, December 24, 1969). Flood- related erosion (as defined in § 59.1) protection was added to the
Program by the Flood Disaster Protection Act of 1973 (Pub. L. 93 -234, December 31, 1973). The
Flood Disaster Protection Act of 1973 requires the purchase of flood insurance on and after March 2,
1974, as a condition of receiving any form of Federal or federally - related financial assistance for
acquisition or construction purposes with respect to insurable buildings and mobile homes within an
identified special flood, mudslide (i.e., mudflow), or flood - related erosion hazard area that is located
within any community participating in the Program. The Act also requires that on and after July 1,
1975, or one year after a community has been formally notified by the Federal Insurance
Administrator. of its identification as community containing one or more special flood, mudslide (i.e.,
mudflow), or flood- related erosion hazard areas, no such Federal financial assistance, shall be
provided within such an area unless the community in which the area is located is then participating in
the Program, subject to certain exceptions. See FIA published Guidelines at § 59.4(c).
(b) To qualify for the sale of federally- subsidized flood insurance a community must adopt and
submit to the Federal Insurance Administrator. as part of its application, flood plain management,
\ regulations, satisfying at a minimum the criteria set forth at part 60 of this subchapter, designed to
\ reduce or avoid future flood, mudslide (i.e., mudflow) or flood - related erosion damages. These
regulations must include effective enforcement provisions.

` (c) Minimum requirements for adequate flood plain management regulations are set forth in § 60.3
for flood -prone areas, in § 60.4 for mudslide (i.e., mudflow) areas and in § 60.5 for flood - related r'
erosion areas. Those applicable requirements and standards are based on the amount of technical
information available to the community.

The May 22, 2013 Special Meeting of the Seward Planning & Zoning Commission was
called to order at 7:00 p.m. by Chair Roach'.

City Administration Report
City Planner Donna Glenz updated the Commission on the following business items:
• Glenz noted that the Seward Chamber of Commerce had posted an internet web link to a
video postcard promoting the community. The aerial video of the waterfront and narrative
was about 13 minutes long.
• The Seward / Bear Creek Flood Service Area board quarterly work session with the
Planning and Zoning Commission was rescheduled from June 4 to June 18.
• Glenz said the May 15 Permitting & Agency Information Day, which was held at the
Community Library, was successful. Various agencies were represented to offer public
information, including the Alaska Department of Fish and Game, the Seward / Bear Creek
Flood Service Area staff and the City of Seward Community Development Department.
• The 7th Annual Armed Services Combat Fishing Tournament was scheduled to be held in
Seward on Thursday, May 23.

Seward resident Lynn Hohl presented a variety of issues related to the planned
development of a City of Seward Electric Department warehouse at 605 Sea Lion Avenue, in the
area of the Seward Elementary School. Hohl said she had been involved with Seward schools and
she was disappointed with the warehouse project information that was made available to the.
public. The background information provided for Planning and Zoning Commission Resolution
2013 -11, supporting the warehouse project, lacked some specific details, Hohl said.
Hohl said she did research to learn more about the project and cited a list of project
concerns in a draft of a letter from the Seward Site -Based Council.
Roach' motioned that the rules be suspended to allow Hohl to speak longer than the
allotted two minutes. Campestre supported the motion and Commissioners unanimously agreed to
allow additional time for the speaker.
Hohl continued to cite several issues, including the proposed placement of a realigned
pedestrian path and how it would intersect with Sea Lion Drive. Continuity of the path should be
developed for travel to and from the other nearby schools, and a natural vegetation buffer should
be planted along Sea Lion Avenue, Hohl said. She also mentioned a need for more sidewalks
along Sea Lion Avenue and the suggestion that lighting be provided for the pedestrian pathway.
Hohl said the proposed placement of a warehouse driveway was too close to the school and
suggested a crossing light could be added at the proposed crosswalk. The Seward Site -Based
Council had also requested to review project plans, Hohl said.
Hohl further addressed project details, including sidewalk width, drainage ditches and the
width of Sea Lion Avenue.

Resolution 2013 -11 of the Seward Planning and Zoning Commission of the
City of Seward, Alaska, supporting the construction of the Electric
Department Warehouse; the relocation of the City water well drainage ditch
and pedestrian pathway on City owned Lot 6A -2, Fort Raymond Subdivision
No. 3 and the construction of the connecting public sidewalk; all located at 605
Sea Lion Avenue within the Institutional Zoning District
• Glenz noted the location of the proposed project and the proposed driveway access and
referred Commissioners to wall maps. Glenz further described the proposed pedestrian pathway
location and the City Code requirements for land use and development. Glenz said the width of
Sea Lion Avenue would not be reduced by the proposed project. Many City meetings had been
held during the project's development, Glenz said.
City Electric Utility Manager John Foutz spoke to the Commission, noting the project
details had been available to the public, public input had been considered and he was determined
to complete a quality project. His own children attended the elementary school, Foutz said.
Foutz pointed out the project boundary and the location of land that was traded between the
City of Seward and the Kenai Peninsula Borough to facilitate the proposed project. Foutz went on
to address the various points brought up by Lynn Hohl during the Citizen's Comments portion of
the meeting.
Foutz described the proposed pedestrian pathway alignment, described the nearby location
of City of Seward water wells, planned drainage and the proposed installation of an underground
electric line to replace an existing overhead line. The proposed warehouse was needed to
consolidate materials and vehicles, Foutz said.
The proposed warehouse would have some lighting because it would be considered critical
infrastructure, Foutz said. Lighting could be added for the pedestrian pathway, but no
determination had been made, Foutz said. Vegetation near the development area would be saved, if
possible, Foutz said. The access driveway location for the proposed warehouse development was
selected based on road development standards for intersections, Foutz said. Signage would be
provided by the City Public Works Department to make the proposed crosswalk as safe as
possible, he said.
Fleming noted for the record that she was involved with the Seward Site -Based Council
when the project letter, referred to by Lynn Hohl, was written. Roach' and Commissioners
determined Fleming had no conflict of interest.
Ecklund asked Foutz to identify the slope and grade at the point where the Sea Lion
Avenue crosswalk would be installed.
Foutz referred Commissioners to the appropriate wall map showing the design.

Ecklund asked Foutz to point out the trail system leading from the proposed pedestrian
path to the high school area.
Foutz identified the trail area, and Commissioners further discussed the trail system and the
proposed pedestrian path width.
Ecklund asked about the installation of culverts for drainage along Sea Lion Avenue.
Foutz pointed out the proposed culvert locations.
Commissioners further discuss issues related to the project.
Roach' asked Foutz about the depth of drainage ditches for the proposed project, citing
concerns about ice forming in winter and possibly being unsafe.
Foutz said the drainage ditches would be designed to handle well water overflow and
should not hold standing water.
Roach' said the driveway at the west side of the elementary school could not normally be
used by children, because they are no allowed to use the back doors of the school to exit the
building. Roach' asked if flares might be added to the pedestrian path to improve visibility and use
at the intersection with Sea Lion Avenue.
Foutz said flares could improve visibility at the proposed crossing location.
Commissioners further discussed the proposed crosswalk, drainage and proposed
construction along Sea Lion Avenue.

Butts said he believed the City of Seward had made good progress on the project and he
did not want to stall the project.
Fleming said that the visibility and safety at the pedestrian pathway intersection with Sea
Lion Avenue was important. She also suggested that the schools be involved in the addition of
vegetation as a buffer to limit the visibility of the warehouse.

Zoning Commission regular meeting.

Fleming thanked Lynn Hohl for discussing issues related to the proposed Electric
Department warehouse project.
Butts thanked administration for the work on the proposed warehouse project.
Campestre said he would work to learn more about community issues as he became more
familiar with the town and thanked staff and the public for participating in the meeting.
McClure thanked staff for the meeting preparations and said the meeting process helped to
identify several issues related the Electric Department warehouse project.
Ecklund said it was helpful when the public attended meetings and provided feedback.
Ecklund also thanked Lynn Hohl and staff for the meeting dialogue.
Roach' thanked Administration and noted that the Commission does not always agree with
Administration. Roach' also said that some of the issues related to the proposed Electric
Department warehouse did not get discussed, but progress was made. Roach' planned to talk with
school district representatives in June about the addition of sidewalks on Sea Lion Avenue.

Lynn Hohl said there might be funding available for the addition of sidewalks on Sea Lion
Avenue and further research was needed. She also said that future development near the school
campuses will require careful planning.
Commission and Administration Response to Citizens' Comments —
Foutz thanked the Commission for letting him address the various issues related to the
proposed warehouse project. He also thanked Lynn Hohi for voicing concerns. Foutz said there •
would be no loss of the drive surface width on the Sea Lion Avenue as a result of the proposed
project. Foutz said he wanted the community to be satisfied with the project.

On October 22, 2012, the City Council directed the City Boards and Commissions to provide
quarterly reports during regularly scheduled City Council meetings. The reports will include a
brief report of the accomplishments, actions or issues related to the Planning and Zoning
Commission.
The City Clerk has requested that the reports be publicly noticed on the Council agenda. In order
to facilitate public notice, the 2013 reports to Council could be provided at the March 26, June
24, September 23 and December 23 Council meetings.
Commissioner Martha Fleming has volunteered to provide the reports, when she is available.
Recommendation: Provide a quarterly report at the June 24, 2013 City Council meeting.
