P Agenda Item: Election of Chair&Vice Chair BACKGROUND&JUSTIFICATION: Each year the Planning and Zoning Commission must elect a chair and vice chair for the coming year. The duties of the Chair are to: 1. Open the meeting on time and call the meeting to order; 2. Announce in proper sequence the business on the agenda; 3. Recognize members who are entitled to the floor; 4. State and put to a vote all legitimate motions that arise during the meeting: 5. Do not permit debate until there is a motion on the floor; 6. Protect the Commission from frivolous or delaying motions by refusing to recognize them; 7. Enforce the rules regarding debate and keep order; 8. Expedite business in a way compatible with the rights of the members; 9. Decide all questions of order; 10. Respond to all inquiries of members; 11. Ensure that citizens address all remarks to the Commission; and 12. Declare the meeting adjourned. The process for election of the chair and vice chair is as follows: The current chair shall open nominations.Any Commissioner can nominate another commissioner as chair. • If only one nomination is received, a motion shall be made to close nominations and cast a unanimous ballot for the chosen person. That motion will need a second and can be approved by unanimous consent. (No role call vote is necessary). • If more than one nomination is received,the clerk will prepare ballots for each Commissioner to vote for one nominee and sign his ballot. The clerk will then collect the ballots,read the votes aloud,and announce the prevailing nominee. A motion is then in order for someone to elect the nominee as chair.A second is needed and the motion can be approved by unanimous consent of the commission. The Building Department was also present to provide information and assistance on the building code requirements. The Commission determined the current City code to be excessive and restrictive in requiring a Conditional Use Permit for Storage Containers and Temporary Structures when a building permit was also required. The Commission has recommended several changes and updates to SCC§15.10.140 Definitions and §15.10.225 Land Uses Allowed. Atwood,Planning Technician Agenda Item: Amending Rule 22 of the Planning and Zoning Commission Rules of Procedure by Resolution 2014-03 BACKGROUND &JUSTIFICATION: At the December 16, 2008 Planning and Zoning meeting the Commission approved Resolution 2008-20 adopting the revised Planning and Zoning Commission Rules of Procedures. The Rules of Procedure utilize the Seward City Code, Seward City Charter, Alaska Statutes and City Council Rules of Procedures. The Rules of Procedure for the Planning and Zoning Commission are a set of rules to guide the Planning and Zoning Commission in carrying out the public process and assist the Commissioners in carrying out the duties of their office. At the January 9, 2012 Seward City Council meeting the Council approved Resolution 2012-02, amending City Council Rules of Procedure Rule 27 to allow three minutes of public comment, up from two minutes, for a total of 36 minutes, up from the previous total of 30 minutes. (See Resolution 2012-02,which is included in the packet.) The Community Development Department has received requests from the public that the citizen comment period for the Planning and Zoning Commission be amended to reflect the time allotted by City Council. For the sake of consistency, the Planning and Zoning Commission Rules of Procedure Rule 22 needs to be amended. To Mayor, City Council j; l'c From: Johanna Kinney, City Clerk 41.450' Agenda Item: Amend Rule 27 of City Council Rules of Procedures BACKGROUND&JUSTIFICATION: During a discussion on the November 28, 2011 council meeting, council expressed their intent to change the time limit for citizens' comments on any subject except those items scheduled for public hearing from two minutes to three minutes per person and from a total time of thirty minutes to a total time of thirty six minutes. By city code, "the order of business for the regular meetings of the City Council shall be set by resolution of the council and incorporated into the Council's adopted Rules of Procedure." (SCC 2.10.55) The item before council tonight is to change Rule 27(c)the following ADDRESSING THE COUNCIL BY THE PUBLIC RULE 27. (c) Citizens' Comments and Discussion. Members of the public or their authorized representatives may address the Council by oral communications on any matter concerning the City's business or any matter over which the Council has control. There shall be two opportunities provided for such comments: (1) Citizens' comments on agenda items not scheduled for public hearing. The Clerk shall make available sign-in sheets on which persons desiring to speak during this time may indicate their desire to do so. CONSISTENCY CHECKLIST: Where applicable, this agenda statement is consistent with the Seward City Code,Charter,Comprehensive Plans,Land Use Plans,Strategic Plan and City Council Rules of Procedures. FISCAL NOTE: No fiscal impact. Approved by Finance Department: RECOMMENDATION: Approve Resolution 2012-002,amending City Council Rules of Procedure,Rule 27,to change the time limit for citizens' comments. 33 17 January 6,2014 RE: Resolution 2014-01 Dear Commissioners and Staff, Just a few comments about this routine interior lot line vacation replat. It seems surprising that "the property owner" would request the replat title to be amended to an out-dated and confusing name: "AVTEC Skill Center" aka Alaska Vocational Technical Center Skill Center. It hasn't been known as the "Skill Center" (actually "Alaska Skill Center")in decades. Why retro with the new conglomerated name when "Leirer Industrial Subdivision, AVTEC Replat, Lot 1A" would be more accurate and make more sense. Page 6: Consistency Checklist Consistency with the Seward City Code at this point in the replat is critical. In addition to the SCC 12.01.030 listed, other applicable city codes could be listed here as reminders and to support compliance. Given the surprising lack of street address marking,the Consistency Checklist would be a good place to remind the applicant of the required proper addressing according to our city code. The fmal Building Occupancy checklist requires it,but despite that requirement, many structures are not addressed in the Leirer Industrial Subdivision. Emergency responders should not have to guess where a fire or other emergency might be, especially in a zone where hazardous chemicals are permitted on site. I suggest the addition of the "Numbering of buildings" and pertinent sections of"SCC 15.20.010 Signs" as these are often overlooked. If the applicant has already complied, great! They get a checkmark. If not,there is added incentive to comply. I did not see any address markers on the current AVTEC buildings on Leirer Road. 4. 12.01.020 Numbering of buildings states that all buildings shall have an assigned address and address numbers shall be affixed to said buildings. There are 4 subsections that should be included: (a) The city manager, or his designee, shall assign an address to each lot or building within the city limits. (b) The property owner of any building to which an address has been assigned within the city limits shall affix to the exterior thereof the numbers assigned to that lot or building. Accessory buildings not assigned a separate address need not have numbers affixed to them. (c) The numbers shall be affixed at a height of between five and eight feet so as to be clearly visible from the street to which the address refers. 1 18 Buildings situated a considerable distance from their street frontage or obscured by trees, shrubs, etc., shall have the address number posted on a plainly visible man-made feature, such as a post, within at least 50 feet of the street named in the address. At the time of the Poland Plat,the Lagoon did not exist,nor the harbor area, so it flowed directly into the bay as shown in the southwest corner of the plat. It's interesting to see these historic documents. Other Comments: 1. Public Comment period: When is the deadline for the public to submit comments for inclusion in the packet? It does not seem likely that there would ever be public inquiries or comments except as lay downs since the public receives notice of the agenda after the deadline for inclusion of comments in the packet. Thus,the comments are not included in subsequent packets to Council or to the Borough,except as an anonymous referral noted in the minutes. The direction of the Council was to have the Planning and Zoning Commission draft and review City Code to allow Mobile Vendors on public ROW and some designated sites of City property. The Council has requested the Commission hold work sessions, develop the Mobile Vendor Code, and request a joint work session with Council before taking any official action. The attached draft schedule is very aggressive and we (Staff and the Commission) may not be able to accomplish it. Please review carefully the schedule and hold a discussion on how the Commission wants to proceed. The Commission has a work session scheduled for March 18, 2014; however that would mean starting the work and discussion on the Mobile Vendors late in the month. Staff is requesting the Commission schedule a work session next week on the 10th or 11th to begin the discussion and work, then hold the regular work session on March 18th to finalize the code.
