The Commission must elect a new Vice-Chair to fill the seat until the annual election in the spring of 2015. It is the duty of the Vice-Chair person to assume the duties of the Chair when necessary. The Duties of the Chair are as follows: 1. Open the meeting on time and call the meeting to order; 2. Announce in proper sequence the business on the agenda; 3. Recognize members who are entitled to the floor; 4. State and put to a vote all legitimate motions that arise during the meeting: 5. Do not permit debate until there is a motion on the floor; 6. Protect the Commission from frivolous or delaying motions by refusing to recognize them; 7. Enforce the rules regarding debate and keep order; 8. Expedite business in a way compatible with the rights of the members; 9. Decide all questions of order; 10. Respond to all inquiries of members; 11. Ensure that citizens address all remarks to the Commission; and 12. Declare the meeting adjourned. The process for election of the Vice-Chair is as follows: The current chair shall open nominations. Any Commissioner can nominate another commissioner as vice-chair. • If only one nomination is received, a motion should be made to close nominations and cast a unanimous ballot for the chosen person. That motion will need a second and can be approved by unanimous consent. (No role call vote is necessary). • If more than one nomination is received, I will prepare ballots for each Commissioner to vote for one nominee and sign his ballot. I will then collect the ballots, read the votes aloud, and announce the prevailing nominee. A motion is then in order for someone to elect the nominee as vice-chairperson. A second is needed and the motion can be approved by unanimous consent of the commission. 3 Sponsored by: Applicant CITY OF SEWARD,ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2014-10 A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF SEWARD, ALASKA, RECOMMENDING KENAI PENINSULA BOROUGH APPROVAL OF THE PRELIMINARY REPLAT OF LOTS 14,15 AND 16,BLOCK 36,ORIGINAL TOWNSITE OF SEWARD, EAGLETON REPLAT,CREATING ONE LOT TO BE KNOWN AS LOT 14A, LOCATED AT 611 SIXTH AVENUE WHEREAS, Russell Oswald, Alaska Registered Surveyor, representing property owners Matt and Kelly Eagleton, has submitted a preliminary plat to the City of Seward for review and recommendation to the Kenai Peninsula Borough; and WHEREAS,this replat combines the three(3)existing lots—Lots 14, 15 and 16,Block 36, Original Townsite of Seward, into one(1)new lot to be known as Lot 14A; and WHEREAS,Lot 14A will consist of 7,593 square feet; and WHEREAS,this parcel contains a legal non-conforming single family home,constructed in approximately 1940 and an existing shed; and WHEREAS, the property is within the Urban Residential Zoning District; and WHEREAS,the new lot meets the minimum lot size and width requirement of the Seward City Code; and WHEREAS,the property is currently serviced by municipal water,sewer,electric and other utilities; therefore a subdivision installation agreement is not required for this replat. This replat will combine three (3) originally platted lots, Lots 14, 15 and 16, Block 36, Original Townsite of Seward, into one lot to be known as Lot 14A. The proposed replat vacates two interior lot lines creating a single parcel of 7,593 square feet. In accordance with Borough requirements, the City must review and comment on a platting action before submittal to the Borough for final approval. Zoning: The lots are currently zoned Urban Residential (UR) -- which is consistent with the Land Use Plan. SCC 15.05.025 (b) (5) Urban residential district(UR). Intended to allow an area of higher density mixed residential uses from detached single-family housing to multi-family apartments in conjunction with compatible low impact professional office uses in the area surrounding the downtown business district. The parcels surrounding this replat are also within the Urban Residential Zoning District and are developed with single or multi-family structures. Utilities: The property is served by existing public utilities and maintained streets; therefore a subdivision agreement is not required. There are appropriate fire hydrants within an approved distance. Size: Lot 14A will contain 7,593 square feet. The new lot will meet the requirement for minimum lot width and buildable lot size for the Urban Residential District. Existing Use: The existing single family home was constructed in approximately 1940 and was built over an existing interior lot line. The structure encroaches into the north side yard setback, it is a legal non-conforming structure, meaning it was built before current zoning requirements and is allowed to remain. 6 Flood Zone: The property is not within a FEMA mapped Flood Hazard Zone. Staff Comments City department heads have reviewed this preliminary replat, the only comment was from the electric department requesting a utility easement on west property line to cover existing utilities. Staff supports the following condition: 1. Continue to work with the City Electric Department to provide the needed utility easement on the West property line.
