The duties of the Chair are to: 1. Open the meeting on time and call the meeting to order; 2. Announce in proper sequence the business on the agenda; 3. Recognize members who are entitled to the floor; 4. State and put to a vote all legitimate motions that arise during the meeting: 5. Do not permit debate until there is a motion on the floor; 6. Protect the Commission from frivolous or delaying motions by refusing to recognize them; 7. Enforce the rules regarding debate and keep order; 8. Expedite business in a way compatible with the rights of the members; 9. Decide all questions of order; 10. Respond to all inquiries of members; 11. Ensure that citizens address all remarks to the Commission; and 12. Declare the meeting adjourned. The process for election of the chair and vice chair is as follows: The current chair shall open nominations.Any Commissioner can nominate another commissioner as chair. • If only one nomination is received, a motion shall be made to close nominations and cast a unanimous ballot for the chosen person. That motion will need a second and can be approved by unanimous consent. (No role call vote is necessary). • If more than one nomination is received,the clerk will prepare ballots for each Commissioner to vote for one nominee and sign his ballot. The clerk will then collect the ballots,read the votes aloud,and announce the prevailing nominee. A motion is then in order for someone to elect the nominee as chair.A second is needed and the motion can be approved by unanimous consent of the commission. (The above procedures should also be used to elect a vice chair) 3 Sponsored by: Applicant CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2015-03 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION OF THE CITY OF SEWARD, ALASKA, RECOMMENDING CITY COUNCIL AND KENAI PENINSULA BOROUGH APPROVAL OF THE CITY OWNED FOURTH OF JULY CREEK SUBDIVISION, SEWARD MARINE INDUSTRIAL CENTER (SMIC), RAIBOW REPLAT; CREATING FOUR (4) NEW LOTS TO BE KNOWN AS LOTS 2 AND 3, BLOCK 4 AND LOTS 4A-1 AND 4D, BLOCK 7; LOCATED WITHIN THE INDUSTRIAL ZONING DISTRICT WHEREAS, Cline and Associates Land Surveyors has prepared and submitted a preliminary replat of City owned Block 4 and Block 7, Fourth of July Creek Subdivision; and WHEREAS, Cline and Associates has submitted the preliminary replat to be known as Fourth of July Creek Subdivision, Seward Marine Industrial Center(SMIC) Raibow Replat; and WHEREAS, this platting action subdivides the un-subdivided remainder of Block 4, Fourth of July Creek Subdivision, SMIC, Plat 2000-6 creating two (2) parcels to be known as Lot 2 and Lot 3, Block 4, involving approximately 12.25 acres; and WHEREAS, this platting action also subdivides Lot 4A, Block 7, Fourth of July Creek Subdivision, SMIC, Plat 2014-17; creating two (2) parcels to be known as Lot 4D and Lot 4A-1; involving approximately 11 acres; and WHEREAS, the properties of this replat are located within the Industrial Zoning District (I); the minimum lot size and lot width as required by City Code have been met; and WHEREAS, Dave Phillips of Raibow Fiberglass and Boat Repair, LLC has requested a long-term lease of two (2) of the parcels depicted in this replat known as Lot 2, Block 4 and Lot 4D, Block 7; and WHEREAS, City staff have reviewed, commented and voiced no concerns with the Fourth of July, SMIC Raibow Replat; and WHEREAS, Block 4 and Block 7 are currently serviced by private roads, some municipal water, sewer, electric and other utilities; therefore no subdivision installation agreement shall be required; and 4 Seward Planning and Zoning Commission Resolution No. 2015-03 Page 2 WHEREAS, the replat protects and provides easements for existing and planned utilities throughout the replat area; and WHEREAS, it is the Planning and Zoning Commission's responsibility to act in an _ advisory capacity to the Seward City Council and the Kenai Peninsula Borough regarding subdivision plat proposals; and WHEREAS, all conditions required by Seward City Code §16.01.015, Conditions to plat approval, were met; the property owners and leaseholders within 300 feet of the requested replat were notified of the proposed subdivision, and the property was posted with public notice signage. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. The Commission hereby recommends that, in accordance with Seward City Code Section 16.01.015 (B), the City Council approve the submittal of the Fourth of July Creek Subdivision, Seward Marine Industrial Center, Raibow Replat to the Kenai Peninsula Borough for approval. In accordance with Seward City Code (SCC) 16.01.015(B) "No preliminary plat of City-owned property may be submitted to the Kenai Peninsula Borough Planning Commission for approval without the prior consent of the City." This replat is located within the Seward Marine Industrial Center (SMIC). This platting action subdivides the un-subdivided remainder of Block 4, Fourth of July Creek Subdivision, SMIC, Plat 2000-6 creating two (2) parcels to be known as Lot 2 and Lot 3, Block 4, involving approximately 12.25 acres. The new Lot 3 will be under a long-term lease to Raibow Fiberglass & Boat Repair, LLC. The second action in this replat subdivides Lot 4A, Block 7, Fourth of July Creek Subdivision, SMIC, Plat 2014-17; creating two (2) parcels to be known as Lot 4D and Lot 4A-1; involving approximately 11 acres. Lot 4D will also be under a long-term lease to Raibow Fiberglass & Boat Repair, LLC. When the platting action is completed the lease agreements with Raibow Boat Repair will be brought before the Council for approval. SUBDIVISION REVIEW: Zoning: The replat is within the Industrial Zoning District. Current development surrounding this replat includes the Vigor Industrial, Communications North and the City boat storage yard parcels. Utilities: The replat area is currently serviced by private roads, some municipal water, sewer, electric and other utilities are available; no subdivision installation agreement shall be required. The surveyor has worked diligently with City staff to provide current and planned utility/access easements. Existing Uses: Block 4 currently contains the private Lot 1A, owned by Pat Marrs, Communications North. The un-subdivided remainder includes the SMIC Harbormater Building and the City's boat storage yard. The parcel to be known as Lot 2 is currently contracted by Raibow Fiberglass & Boat Repair, LLC. (Development) Staff Comments: All staff and administration concerns have been addressed and all City department heads recommend approval of this preliminary replat. Public Comment: Lease holders within three hundred (300) feet of the proposed platting action were notified of this public hearing. Public notice signs were posted on the property, and all other public hearing requirements of Seward City Code §15.01.040 were complied with. At the time of this publication the Community Development Department has received two (2) public inquiries, one requesting a digital copy of the plat and the other a clarification on the location of the new parcels. If any further correspondence is received after publication of this agenda statement, it will be presented as a lay down item at the Commission meeting. This lot line vacation will combine Lots 26A and 28A into a single parcel of approximately 12,600 square feet. In accordance with Kenai Peninsula Borough requirements, the City must review and comment on a plat before submittal to the Borough for approval. SURROUNDING LAND USE AND ZONING: The lots are zoned Urban Residential (UR): SCC 15.05.025 (b) (5) Urban residential district (UR). Intended to allow an area of higher density mixed residential uses from detached single- family housing to multi-family apartments in conjunction with compatible low impact professional office uses in the area surrounding the downtown business district. The two lots in this replat are currently undeveloped, vacant lots. The parcels to the north of this replat are zoned Urban Residential and developed with a multi-unit housing complex. The parcels to the east across Brownell Street are zoned Single Family (R1) and developed with single family homes. The parcels to the south are within the Urban Residential Zoning District; the abutting parcel contains a small single family home and the parcels further south remain undeveloped. The parcel to the west is a large undeveloped portion of Bear Mountain and is zoned Resource Management. Floodplain status: According to the FEMA Flood Insurance Rate Map, this property is located outside of any special flood hazard area areas. Utilities: The property is served by the existing public utilities and maintained streets, therefore a subdivision agreement is not required. Existing water, sewer and electric lines are located in the adjacent rights-of-way. Size: Lots 26, 27 and 28, Block 12 of the Original Townsite plat were original 30 X 100 foot lots. "The railroad is an economic engine for Seward... What happens here also has a ripple effect out to Western Alaska...We don't look at this as trying to get a bigger slice for us;we're trying to create a bigger pie for everyone,"Terry said. A spokesperson for MARAD said that the specifics of the studies,their timelines and budgets awaited a final, signed agreement anticipated early in 2015. ARRC built the 750-foot-long west dock in 1966 after the 1964 earthquake.Although steel pilings have strengthened it over the years,Terry said that the dock still has a majority of older,wooden pilings.Railroad 37 http://www.msiak.net/aca/261/02.html 2/9/2015 Railroad looks to expand terminal Page 2 of 2 rails still run along the east face,but according to Terry,weight restrictions no longer allow trains onto the dock.The dock now handles passengers and lighter freight.Many cruise ships that visit Seward extend well beyond the end of the dock when berthed there. The ARRC 550-foot-long east dock(freight dock)consists of a steel,sheet-pile bulkhead and rock/gravel fill located east of the pile-supported west dock.Railroad rails run out to the freight dock,which has no weight restrictions.The freight dock has a gravel ramp that allows appropriately equipped vessels to roll on and roll off freight.Although ARRC enlarged the freight dock somewhat in 2007,it still has limited room for handling bulky materials,such as pipe.
