HomeMy WebLinkAboutRes2015-019 Sponsored by: Planning and Zoning Commission CITY OF SEWARD, ALASKA RESOLUTION 2015-019 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, RECOMMENDING KENAI PENINSULA BOROUGH APPROVAL OF THE CITY OWNED FOURTH OF JULY CREEK SUBDIVISION, SEWARD MARINE INDUSTRIAL CENTER (SMIC), RAIBOW REPLAT; CREATING FOUR (4) NEW LOTS TO BE KNOWN AS LOTS 2 AND 3, BLOCK 4 AND LOTS 4A-1 AND 4D, BLOCK 7; LOCATED WITHIN THE INDUSTRIAL ZONING DISTRICT WHEREAS, Cline and Associates Land Surveyors has prepared and submitted a preliminary replat of City owned Block 4 and Block 7, Fourth of July Creek Subdivision; and WHEREAS, Cline and Associates has submitted the preliminary replat to be known as Fourth of July Creek Subdivision, Seward Marine Industrial Center(SMIC) Raibow Replat; and WHEREAS, this platting action subdivides the un-subdivided remainder of Block 4, Fourth of July Creek Subdivision, SMIC, Plat 2000-6 creating two (2) parcels to be known as Lot 2 and Lot 3, Block 4, involving approximately 12.25 acres; and WHEREAS, this platting action also subdivides Lot 4A, Block 7, Fourth of July Creek Subdivision, SMIC, Plat 2014-17; creating two (2) parcels to be known as Lot 4D and Lot 4A-1; involving approximately 11 acres; and WHEREAS, the property is located within the Industrial Zoning District (I); minimum lot size and width as required by City Code have been met; and WHEREAS, Dave Phillips of Raibow Fiberglass and Boat Repair, LLC has requested a long-term lease of two (2) of the parcels depicted in this replat known as Lot 2, Block 4 and Lot 4D,Block 7; and WHEREAS, Block 4 and Block 7 are currently serviced by private roads, some municipal water, sewer, electric and other utilities; therefore no subdivision installation agreement shall be required; and WHEREAS, the replat protects and provides easements for existing and planned utilities and access throughout the replat area; and WHEREAS, City staff have reviewed, commented and voiced no concerns with the Fourth of July, SMIC Raibow Replat; and CITY OF SEWARD, ALASKA RESOLUTION 2015-019 WHEREAS, it is the Planning and Zoning Commission's responsibility to act in an advisory capacity to the Seward City Council and the Kenai Peninsula Borough regarding subdivision plat proposals; and WHEREAS, the Seward Planning and Zoning Commission held a public hearing on March 3, 2015 and approved P&Z Resolution 2015-03, recommending Council and the Kenai Peninsula Borough approve the Fourth of July Creek Subdivision, Seward Marine Industrial Center, Raibow Replat; and WHEREAS, in accordance with Seward City Code Section 16.01.015 (B), no preliminary plat of city-owned property may be submitted to the Kenai Peninsula Borough for approval without prior consent of the City Council. NOW, THEREFORE, BE IT RESOLVED BYTHE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA,that: Section 1. The Seward City Council recommends the Kenai Peninsula Borough Planning Commission approve the Fourth of July Creek Subdivision, Seward Marine Industrial Center, Raibow Replat. Section 2. This resolution shall take effect 30 days after passage and posting as required by Seward City Code § 7.05.145. Meeting Date: March 23, 2015 Y, To: City Council jOrig �ASM� Through: Jim Hunt, City Manager Ron Long,Assistant City Manager From: Donna Glenz,Planner Agenda Item: Resolution 2015- 00 recommending City Council and Kenai Peninsula Borough approval of the Fourth of July Creek Subdivision, Seward Marine Industrial Center, Raibow Replat BACKGROUND &JUSTIFICATION: Attached for the Council's review and recommendation to the Kenai Peninsula Borough Planning Commission is a preliminary plat submitted by Cline and Associates on behalf of Dave Phillips, Raibow Fiberglass & Boat Repair, LLC. In accordance with Seward City Code (SCC) 16.01.015(B) "No preliminary plat of City-owned property may be submitted to the Kenai Peninsula Borough Planning Commission for approval without the prior consent of the City." This replat is located within the Seward Marine Industrial Center (SMIC). This platting action subdivides the un-subdivided remainder of Block 4, Fourth of July Creek Subdivision, SMIC, Plat 2000-6 creating two (2) parcels to be known as Lot 2 and Lot 3, Block 4, involving approximately 12.25 acres. The new Lot 3 will be under a long-term lease to Raibow Fiberglass &Boat Repair, LLC. The second action in this replat subdivides Lot 4A, Block 7, Fourth of July Creek Subdivision, SMIC, Plat 2014-17; creating two (2)parcels to be known as Lot 4D and Lot 4A-1; involving approximately 11 acres. Lot 4D will also be under a long-term lease to Raibow Fiberglass & Boat Repair, LLC. When the platting action is completed the lease agreements with Raibow Boat Repair will be brought before the Council for approval. SUBDIVISION REVIEW: Zoning: The replat is within the Industrial Zoning District. Development surrounding this replat includes the Vigor Alaska, Communications North and the City boat storage yard parcels. Utilities: The replat area is currently serviced by private roads, some municipal water, sewer, electric and other utilities are available; no subdivision installation agreement shall be required. The surveyor has worked diligently with City staff to provide current and planned utility/access easements. Existing Uses: Block 4 currently contains the private Lot 1A, owned by Pat Marrs, Communications North. The un-subdivided remainder includes the SMIC Harbormater Building and the City's boat storage yard. The parcel to be known as Lot 2 is currently contracted by Raibow Fiberglass & Boat Repair, LLC. Block 7 currently contains the Vigor Alaska lease parcels, the City Vessel Washdown Pad, Polar Seafoods storage parcel, the transfer rails for the vessel syncrolift and driveway and utility easements. The parcel to be known as Lot 4D is also currently contracted by Raibow Fiberglass &Boat Repair, LLC. Flood Zone: The area is within a Flood Zone D,which are areas of undetermined flood hazards. INTENT: To establish parcel lot lines for two (2)new parcels proposed to be leased to Raibow Boat Repair with long-term leases. Approved by Finance Department: :; L,,. .i Staff Comments: All department heads and administration reviewed the proposed replat,no concern were voiced. Public Comment: Lease holders within three hundred(300) feet of the proposed platting action were notified of the public hearing. Public notice signs were posted on the property and all other public hearing requirements of Seward City Code §15.01.040 were complied with. At the time of the Public Hearing before the Planning and Zoning Commission two (2) public inquiries were received, one was requesting a digital copy of the plat and the other a clarification on the location of the new parcels. No other concerns were received.
