Opening Ceremony Commissioner Fleming led the Pledge of Allegiance to the flag. Roll Call There were present: Gary Seese presiding, and Martha Fleming Janet Coulter Tom Swann comprising a quorum of the Commission; and Donna Glenz, City Planner Dwayne Atwood, Planning Technician Excused was: Cindy Ecklund and Margaret Anderson City Administration Report City Planner Donna Glenz updated the Commission on the following business items: • Glenz noted that no serious events or accidents occurred during the Fourth of July holiday. • One new floodplain development permit was issued for a private bridge project at Japp Creek, north of the Seward Airport. • City Administration had no updated information regarding State of Alaska plans to upgrade the Seward Airport. • Glenz requested that the Commission add a new business item to the agenda related to a July 20 training on the elements of City Government, including the Open Meetings Act, ethics and other topics. The training session was scheduled for 5:30 p.m. at the Seward Community Library Museum. • Glenz said she would be out of state until August 3, and Planning Technician Dwayne Atwood would be supporting the Community Development Department if Commissioners needed anything. s ' City of Seward,Alaska Planning Commission Minutes July 14, 2015 Volume 7,Page 148 Other Reports,Announcements & Presentations—None Citizens' Comments on any subject except those scheduled for Public Hearing—None Approval of Agenda and Consent Agenda Motion (Swann/Coulter) Approve the Agenda and Consent Agenda Motion (Fleming/Coulter) Add Item D under New Business as "Discussion, Attendance and Commitment for a July 20 Council, Board and Commission Training." Motion Passed Unanimous The following items were approved on the Consent Agenda: June 2,2015 Regular Meeting Minutes Unfinished Business Items requiring a Public Hearing—None New Business Items requiring a Public Hearing— Resolution 2015-14 of the Planning and Zoning Commission, of the City of Seward, Alaska recommending City Council and Kenai Peninsula Borough approval of the City owned Seward Tidelands Survey ATS 1574, Tract A, Replat No.2; located on the east side of Resurrection Bay within the Resource Management Zoning District Glenz noted the location on wall maps and explained that the replat involved City-owned submerged tidelands. The 10 acre parcel was approximately north of the Seward Marine Industrial Center. The parcel was to be set aside as a project mitigation site related to a U.S. Army Corps of Engineers dredging permit issued for the Seward Marine Industrial Center breakwater improvement, Glenz said. Staff had received three questions from the public about the proposed replat, but no further questions once the location and purpose of the land action was explained, Glenz said. Fleming asked whether the other surrounding parcels would need to be platted. Glenz explained the tidelands platting around Resurrection Bay, and said it was a goal of the City to complete tidelands platting in the future. Hearing no one wishing to speak,the public hearing was closed. Motion (Swann/Fleming) Approve Resolution 2015-14 Motion Passed Unanimous Resolution 2015-15 of the Planning and Zoning Commission, of the City of Seward, Alaska recommending City Council and Kenai Peninsula Borough approval of the Forest Acres Levee Replat No. 2; creating seven (7) parcels; vacating undeveloped rights-of-way and utility easements while dedicating new rights-of-way and utility easements; located north and south of the North Forest Acres Levee (Dieckgraeff Road) located within the Resource Management Zoning District Glenz said the platting action would vacate rights of way that were no longer being used, since the development of the levee and realignment of the road to the solid waste transfer station area. The land action was within the Resource Management Zoning District, and included parcels owned by public entities and private parties. There was no public opposition to the proposed replat, Glenz said. Notice of public hearing being posted and published as required by law was noted and the public hearing was opened. Hearing no one wishing to speak,the public hearing was closed. Motion (Swann/Fleming) Approve Resolution 2015-15 Motion Passed Unanimous Unfinished Business—None New Business Items— Resolution 2015-16 of the Seward Planning and Zoning Commission, recommending Kenai Peninsula Borough approval of Lot 1A, Block 24, Original Townsite of Seward,Lawrence Replat, at 437 Fourth Avenue Glenz said the replat would vacate interior lot lines to create a parcel of approximately 9,000 square feet, with 90 feet of street frontage along Fourth Avenue. Staff had received no comments from the public, Glenz said. Motion (Swann/Fleming) Approve Resolution 2015-16 City of Seward,Alaska Planning Commission Minutes July 14, 2015 Volume 7,Page 150 Motion Passed Unanimous Resolution 2015-17 of the Seward Planning and Zoning Commission, recommending Kenai Peninsula Borough approval of Lot 16A, Block 9, Original Townsite of Seward, Snowden Replat, at 209 Fifth Avenue Glenz said the proposed replat would combine two existing lots and a portion of a third, containing approximately 6,500 square feet. The property included a commercial structure that was built over an interior lot line several years ago. During a recent building permit site plan review, staff discovered the need to vacate interior lot lines. Glenz noted that the land action would require that one electrical easement and one encroachment be noted on the plat, Glenz said. Fleming asked staff to describe the electrical easement. Glenz referred the Commission to the location of an overhead power service that served an adjacent property to the north. Glenz also noted the encroachment of steps from the adjacent structure to the north. Swann asked if there were encroachments onto municipal property. Glenz said there were no known encroachments onto City property at either the street or the • alley. Swann asked staff how building permit applicants would be required to follow through and complete a replat, if needed. Glenz said applicants would not receive a certificate of occupancy from the Building Department if a required replat was not completed. Motion(Fleming/Swann) Approve Resolution 2015-17 Motion Passed Unanimous Discussion, Attendance and Commitment for a July 20 Council, Board and Commission Training Glenz noted that the city boards and commissions were scheduled to receive training on the elements of city government. The City of Seward would provide food at the training, and was seeking any input or requests prior to the class. Glenz said City staff wanted to confirm who might attend. Following discussion,the four Commissioners present indicated they would attend. Glenz said the content and format would be similar.
