Through: Ron Long, Assistant City ManagerF 'ilkow � g4..dSKP From: Donna Glenz, Planner 4-1-Af Agenda Item: Land Use Plan and Zoning amendments of Lots 9A through 12, Block 7, Federal Addition, located between C and D Streets on the East side of Second Avenue, from Single & Two Family Residential (R1 & R2) to Auto Commercial (AC) BACKGROUND & JUSTIFICATION: Attached for the Commission's review and recommendation is Resolution 2016-07 recommending City Council approve the attached Ordinance 2016- , amending the Land Use Plan for Lots 9A through 12, Block 17 of the Federal Addition from Two-Family Residential (R2) to Auto Commercial (AC). And amending the Zoning designation of Lot 9A, Block 17, Federal Addition Clark-Tougas Replat, from two family residential (R2) to Auto Commercial (AC) and Lots 10, 11 and 12, Block 17, Federal Addition from single family residential (R1) to Auto Commercial (AC) (see attached maps). This requested amendment area is located on the east side of Second Avenue between C and D Streets. Lot 9A is currently zoned Two Family Residential (R2), is approximately 60' X 100' and covers approximately 6,021 square feet. The parcel currently contains two single family homes under one ownership. This applicant would like to use the second house as a rental on a nightly basis. Lots 10 and 11 are each 50' X 100' and combined contain approximately 10,000 square feet. These two parcels contain a single family home and accessory structures, currently zoned Single Family Residential (R1); the owners support the zoning amendment to Auto Commercial. Lot 12 is 50' X 100', approximately 5,000 square feet and zoned Single Family Residential (R1). This lot currently contains a multi-family structure with three apartment units, this structure was built in approximately 1945, before local zoning was adopted and is considered a non- conforming structure and use within the Single Family Zoning District. The applicant would like bring the multi-family use into compliance with the zoning code. These property owners located on the east side of Second Avenue between C and D Streets have applied for the Land Use Plan and Zoning designation amendment stating they would like to unite the zoning with the current zoning on north and east portions of Block 17 and that they would like to bring the existing and future uses into compliance by rezoning to Auto Commercial. The adjoining parcel to the north is zoned Auto Commercial and contains a 12 unit commercial 7 bunkhouse. The parcels to the east, across the alley, contain a commercial warehouse, and two (2) single family homes, all zoned Auto Commercial, also a commercial office building currently zoned Central Business District (CBD). The parcels to the south across C Street contain a large single family home used a B & B and is zoned Single Family (R1). The lots to the west across Second Avenue are currently vacant and within the Urban Residential (UR) zoning district. Seward City Code (SCC) §15.01.035, Amendments, (b) (1) (c) and (3) allow the consideration of this rezone because the application is signed by all property owners in the area to be amended; and the request alters the existing boundary of the contiguous zoning district. No objections or concerns were expressed from City staff. At the time of this review no public comment was submitted to staff. Property owners within three hundred (300) feet of Lots 9A through 12, Block 17, Federal Addition were notified of this proposed rezone. Public notice signage was posted on the properties, and all other public hearing requirements of Seward City Code §15. 01.040 were complied with. Floodplain Management to Adopt the Revised Floodplain Rate Maps (FIRM) and the Flood Insurance Study(FIS)Dated October 20, 2016 BACKGROUND &JUSTIFICATION: About four (4) years ago the Federal Emergency Management Administration (FEMA) started work to provide information on Coastal Flooding issues of the Kenai Peninsula Borough in new Flood Insurance Rate Maps (FIRM) and the Flood Insurance Study (FIS). During that time City staff and the Seward Bear Creek Flood Service Area Board (SBCFSA) have held numerous meetings and teleconferences with FEMA regarding the program to revise the September 27, 2013 maps. In November of 1998 City Council adopted Ordinance 98-11 establishing Chapter 15.25 Floodplain Management of the Seward City Code. City Council also adopted Resolution 98-127 authorizing the participation in the National Flood Insurance Program (NFIP). The 1981 FIRM maps were digitized, the City Code was amended to adopt the new digitized September 27, 2013 maps and to update title 15.25 Floodplain, with Ordinance 2013-010 at the July 8, 2013 Council meeting. Since the September 27, 2013 maps were adopted, FEMA and the STARR contractors have been working on providing coastal study map revisions for the Kenai Peninsula. City staff and the Seward Bear Creek Flood Service Area Board have held several public meetings and worked diligently with FEMA over the last three years. On April 20, 2016 the Federal Insurance Administration issued the letter of final determination on the October 20, 2016 revised FLRM. Once the letter of final determination has been issued the City has six (6) months to officially adopt the maps. If the City were to choose to not adopt the maps the City would be removed from the NFIP and become ineligible for flood related federal funding. The only Code change necessary at this time, in order to remain eligible for the NFIP is the adoption of the October 20, 2016 FIS and FIRM. These zones are depicted on a community's Flood Insurance Rate Map (FIRM) or Flood Hazard Boundary Map. Each zone reflects the severity or type of flooding in the area. Moderate to Low Risk Areas In communities that participate in the NFIP,flood insurance is available to all property owners and renters in these zones: ZONE DESCRIPTION B and X(shaded) Area of moderate flood hazard, usually the area between the limits of the 100- year and 500-year floods. B Zones are also used to designate base floodplains of lesser hazards, such as areas protected by levees from 100-year flood, or shallow flooding areas with average depths of less than one foot or drainage areas less than 1 square mile. C and X Area of minimal flood hazard, usually depicted on FIRMs as above the 500-year (unshaded) flood level. Zone C may have ponding and local drainage problems that don't warrant a detailed study or designation as base floodplain. This rezone request is located on the west side of Second Avenue between Jefferson and Madison Streets. The applicants of this rezone request have stated they own two single family homes within the rezone requested area and wish to rent one of these homes as a house rental on a nightly basis. House rental on a nightly basis is not allowed within the Single Family district but is allowed within the Urban Residential district. They have worked with the neighbors to the north and south and have submitted an application requesting the Land Use Plan and Zoning Map amendments signed by all of the property owners being considered in the rezone request. The zoning history of the First and Second Avenue corridor south of Van Buran has been changed several times in the last 30 years. In 1985 the Land Use Plan delineated the area between Washington and Madison along First and Second Avenue as Multi-Family (R3), at that time the Kenai Peninsula Borough held the zoning authority. In 1985 Lots 17 through 20, Block 26 were rezoned from Single family(R1) to Multi-family (R3). In October 1989 the City Council enacted Resolution 89-109 and Ordinance 625, accepting zoning and land use authority from the Kenai Peninsula Borough. In January 1992, by Ordinance 665, City Council amended the Land Use Plan of all R1, R2, and R3 zoning within the OTS, Federal, Laubner & Cliff addition south of Mill Street changing the designation to Urban Residential (UR). During the next few years, many properties within the First and Second Avenue corridor applied for and were granted a rezone to Urban Residential (UR) aligning their properties with the Land Use Plan. Lots 17 —20, Block 26 were among those properties and they remain Urban Residential zoning today. In 1997, the Land Use Plan was amended by Ordinance 97-07 changing certain properties within the First and Second Avenue 35 corridor from Urban Residential (UR) to Two Family (R2). With the adoption of the Land Use Plan within the current Comprehensive Plan, the area along First and Second Avenue was designated as Single Family(R1). The Urban Residential designation is described as allowing a higher density of mixed residential uses along with compatible, low-impact professional offices in the area surrounding the downtown business district, allowing for more flexibility in land use. In the 1992 agenda statement written by former Community Development Director, Kerry Martin it was noted "The goal in the change to Urban Residential zoning is to reflect the reality of what is happening in the community and to allow for more land use flexibility to encourage development of our limited land resource without sacrificing the quality of life." That statement was true then and remains true today. We continue to see the public requesting to develop and/or use personal property to its highest potential. Lots 1 through 16, are currently zoned Single Family Residential (R1) and developed with a large church, single family homes and open space. Lots 17-20 are currently zoned Urban Residential (UR), Lots 17 & 18 are undeveloped and Lots 19 &20 contain a single family home. The current Land Use Plan designates Lots 1 through 20 as Single Family Residential (R1). The surrounding area is prominently within the Single Family Zoning District(R1) on both Land Use Plan and the Zoning Maps. The Seward City Code SCC §15.01.035,Amendments, (b)Initiation (1) (c) and(b) (3) allows the consideration of this rezone because all of the property owners in the area to be amended signed the application requesting the zoning amendment; the area is contiguous to Urban Residential Zoning(UR)on the south and the area contains more than one(1) acre in total. Staff had no code enforcement concerns for development within the Urban Residential district. At the time of this review staff has received one phone inquiry regarding any possible change to the parking requirements within the Urban Residential (UR) zone. Staff noted there are no differences in parking requirements between Single Family (R1) and Urban Residential (UR). One written public comment was submitted to staff, which has been included in the packet provided to the Commission. Three public comments have been received and included in the packet provided to the Commission. The comments spoke against the rezone stating the rezone could cause the future possibility of increased noise,traffic, congestion and loss of quality of life. Property owners within three hundred (300) feet of Lots 1 through 20, Block 26, Original Townsite of Seward were notified of this proposed rezone. I object to the proposed disintegration of our neighborhood, replacement of low density residential use for high density mixed uses, and the exchange of neighbors for strangers with empty houses in the winter. I have lived on the west side of this block across the alley from this proposed rezone since the early 1980s. It is a wonderful residential, Single-family Residential (R1) neighborhood. By code, this zone is intended to provide stable, quiet, low density, detached single-family residential development. And it is quiet, with low traffic. We are far enough away so that we do not hear the cruise ship loudspeakers, the train whistle or locomotives, or traffic on Third Avenue. Since we are in the hospital quiet zone, even the ambulance sirens are silenced here. This is an old, stable, low density neighborhood, with well-kept, detached single family homes with off-street parking, many with historic landscaping on large lots. Neighbors know each other; we chat on the street, take care of each other's pets and plants, loan tools and offer advice, and help each other out when needed; we are neighbors. Our neighborhood reflects key 2020 Comp Plan Community Values: "Small town feel and friendly atmosphere; people are friendly and you know your neighbors; a comfortable, relaxed attitude; an attractive community appearance." (V1, p 10) "We value quiet in our residential neighborhoods." (V1, p 11) Of the 13 properties on my block between First and Second, Madison and Jefferson, the majority, (9) are private, single family residences. One property has a church that generally only operates on Sundays. One property is vacant; the other vacant property is soon to be replatted into the adjacent residential lot. The applicant operates the only B&B on the block. This applicant recently purchased the home next door after the decades-long owner moved, and converted it to monthly lodging. Suddenly, there are strangers living there, 46 currently construction workers, who will never be part of the fabric of our neighborhood or community. Ironically, the applicant's B&B advertises the quiet residential nature of this neighborhood even while the applicant is in the process of trying to undermine that quality. I purchased a vacant lot across from this block on Second because of the quiet residential nature of this neighborhood, its R1 zoning, and the R1 zoning surrounding it. That was a major factor for my purchase in planning for the future. The Comp Plan supports Seward's small town scale, historic character, and vital residential center with well-kept older homes lining paved streets, separate from the larger commercial and industrial developments (VII, p 6). The applicant wants to rezone from R1 to UR so that his monthly lodging use can be nightly lodging. Urban Residential (UR) is intended to allow an area of higher density, mixed residential and professional uses. (VII, p 26) Rezoning the east side of this block from Single Family Residential (R1) to Urban Residential (UR) will forever change the quality of this quiet neighborhood. The rezone will also allow the rezone of adjoining R1 property to UR, spreading like an invasive weed. UR is a hodgepodge of higher density commercial uses, ranging from a child care center, senior or teen center, radio/TV studio, art gallery, to a hostel, rooming/boarding house, duplex, multifamily dwelling of 3 or more units, multi-family apartments lodging, condos, townhouses/row houses. Changing the zone from R1 to UR must take these other potential uses into consideration. The 2020 Comp Plan recommends evaluating the combination of UR with Office Residential (V1, p 20.) If this occurs, what ELSE will be allowed in this R1 neighborhood and potentially, adjacent properties? The 2020 Comp Plan states, "We value orderly growth and balanced development that is driven by community consensus in conformance with the land use plan." (V1, p 14) Rocketing from R1 to UR, or a combination of 47 ` UR/OR, is NOT orderly growth and is not supported by the Plan or many of my neighbors. In addition, the Plan states, "We value a stable economic environment, economic diversity, year-round businesses..." (V1, p15) "Expand the opportunity for affordable, diverse, year-round housing..." (V1, p 20) Rezoning to permit a single family residence to become nightly lodging will likely result in one less family having a year-round home, and yet another shuttered residence after the 90-day summer season. Seward is a desirable place to live only if there ARE places to live, year-round. Finally, the Comp Plan supports a high "Quality of Life" by "enhancing the `sense of community', "maintain Seward's small town, family-oriented character throughout the growth process." An R1 zone has a distinct feel and ambiance to it ...it's residential, first and foremost.
