The Jesse Lee Home Parcel PACAB suggested that Council lease this property to the Friends of the Jesse Lee Home with an option to purchase,perhaps enabling the group to move forward with planning and fund raising for their efforts. SMIC lots Recommendation was made that these parcels should be made for available for sale consistent with Seward Marine Industrial Center Development plan and zoning codes. Alaska Logistics Parcel The Board recommended that the parcel be offered for sale with a Right of First refusal offered to Alaska Logistics. 3rd Avenue Tot Lot PACAB recommended sale of this lot(Original Townsite Block 10 Lots 35-36) at fair market value. Parcel in North Harbor It was the recommendation of the board that this lot(Marina Subdivision Block 2 Lot 1)be retained by the City for travel lift use, associated harbor infrastructure and walking corridor beautification. PARKS The city has a number of sites that have been designated as public parks within the city's Land Use Plan and the 1992 Park Master Plan,both adopted by Council resolution. "no name"Park(Waterfront Tracts Park). Located at the foot of Fourth Ave,along Railway Ave,this is the most historic park in Seward. Although alternatively known through the years as Niles,Arcade,Ladies and Iditarod Park, Harry Hoben is credited with actually developing it.The Historic Preservation Commission is currently working on having the park named officially. The listing of publicly owned lands is thorough and valid. We would like to address our concern over the Third Avenue Playground lot being listed as review for disposal. The playground serves hundreds of children and young families each year. It is a safe, fenced playground adjacent to Kawabe Park(a passive park)and restroom. The park has a good history, and has emotional connections to many Seward residents. It is improved and maintained within the City's General Fund. Some community members believe that because we have the new PARKS playground,there is no longer a need for the older playgrounds. This viewpoint fails to recognize that children desire and need play alternatives. Also, some families and groups prefer the older playgrounds due to their convenient locations and less crowded environments. These points of view are valid and noteworthy. This note does not discuss the merits of disposal. It is prudent,however,to note that there are a significant amount of privately held vacate or `abandoned' lots within immediate proximity which should be studied before disposing Third Avenue Playground. While working with the ALPAR Litter Patrol crew this summer,a slower,purpose-filled walk really brings forward the obvious current state-of-downtown. There are many buildings and lots under-utilized,unused or vacant. The community should focus on revitalizing these neighboring properties before taking something so treasured and valuable to young families and children. We recommend that the City Council develop a guideline or policy such as, "When 95%of all downtown lots are actively used to their highest function with seasonal to year-round commerce .... Or when downtown parking is at such a premium to cause parking problems.... Then this particular lot should be considered for disposal." Until these neighboring properties are developed and used, or until such a time that `supply-and- demand' require the disposal, we believe the City should leave this playground jewel off the list. It would almost be unfair competition to those downtown lot owners now who are seeking commercial developers if the City were to compete against their sale by removing the Third Avenue Playground. We restate our challenge that an on-the-ground-eye-view of the downtown area(with an eye for un-used or under-utilized space)will point out that the current highest,best-use of the Playground is a Playground because of the many other options in the immediate and adjacent areas. Harbor Fund (map 4-38) The following leases are all located within the Fourth of July Creek Subdivision which is a replat of USS 4827,USS 4827,AS 76-69,ATS 1222 and Fourth of July Creek Tracts A-E. The Seward Marine Industrial Center(SMIC)is considered to be the±100 acres supporting the shiplift/north dock basin. These lands were acquired through municipal entitlement under the Alaska Statehood Act and through land trades with the Kenai Peninsula Borough.With the exceptions as noted,they are all zoned Industrial. All descriptions are based on the preliminary subdivision plat of this area. . 1161 MACtel Cellular Systems cellular phone tower(L-92) (Prelim FOJC Subd Tract M,portion of). Rent varies from free to fair market value.Most lease rents are adjusted by appraisal every five years.They are identified by lessee,use and general legal description. The number in parenthesis(RE- 000)is the city's administratively assigned lease number. • AVTEC Old Armory Building(L-027)(Federal Addition Block 6). This Institutional designated 66,000 SF parcel is located on Second Ave between A and B Street.The south half of the properly is undeveloped,but has been considered for parking in support of the AVTEC facility.The north half is the location of the old National Guard Armory which now houses the AVTEC building trades/EMT programs. The site was acquired from the federal government in 1953,and leased at no cost to the state Department of Education in 1955 for 99 years. The city has no identified future need of the parcel.Recommendation: Trade for other state lands. General Fund (map 2-9) (see Surplus lands) ADF&G Egg Building(L-028) (north end Lagoon).This is the small building located at the north end of the lagoon,near the Benny Benson monument. The building foot print was leased at no cost to the state in 1978 for 10 years,which was extended through 1998. The building has not been used for a number of years.It could be used by the Parks and Recreation program for maintenance equipment and supplies.Recommendation:Retain land ownership.If state can show a specific need for the site, consider renewing the lease when it expires. Otherwise assume ownership of the building for Parks and Recreation use General Fund (map 3-4) Alaska DNR Caines Head Trailhead Parking(L-065) (Deacon Subd No.2 Lot 3). This 15,000 SF portion of the sewer lagoon site at Lowell Point is used as a trailhead parking area for the Caines Head trail.Leased in 1988 at no cost.Recommendation:Retain land ownership and continue lease so long as there is not a need for the property related to the sewer lagoon. Water/Sewer Fund (map 1-1) The following parcels are within the Fort Rayriond Subdi vision. The lands making up this subdivision include USS 1756 acquired from the federal government in 1933 as a cemetery reserve, USS 149 Tract B Lot 2 purchased from the state for a campground site; arid the military recreation camps USS 242 Tract A Lots 1-3 from the state through municipal entitlement. ! This one acre Institutional zoned parcel at the corner of the Seward Highway and Coolidge Drive was leased in 1989 for 20 years at no cost to the 1 Seward Chamber of Commerce as an office and visitor information center. It is encumbered by a main r underground electric vault and line. Recommendation: Retain land ownership and continue lease as a 1 contribution to the Chamber of Commerce General Fund (map 3-5) Military Recreation Camps US Corps of Engineers (Fort Raymond Subd). The two camps are under three g leases.The Army(L-034)is on 11.8 acre Lot 8A and the Air Force(L-035)on 11 acre Lot 7A. Lease L-023 of e 13,200 SF legitimizes a trespass of the Air Force trailers a few feet into the cemetery. All sites are zoned :s Institutional.The Army site fronts Dimond Blvd and Sea Lion Ave.The Air Force camp fronts both the Seward 3. Hwy and Dimond Blvd.It includes city water wells 1,2 and 3 and a major transmission line easement. The camps d are hemmed in with no growth potential. Possible replat to dedicate existing "driveways" as public ROW for legal access of some lots may be necessary. 25 IP 4.OF seitf1 Memo To: Christy Terry, Community Development Director From: David Squires, Fire Chief Date: November 15, 2010 Re: Comments on sale of City parcels After the discussion on this subject at the project meeting on November 9, 2010; I wanted to research an outstanding question that has continually been asked. My comments are aimed at the SMIC lots and are not intended to discourage this effort. Under the Seward City Code, Title 16, Section 16.01,010 Definitions; Subdivider, owner, proprietor or developer: a person, firm, association, partnership, corporation, government unit or combination of any of these which may hold any legal or equitable ownership interest in land being subdivided or which has been subdivided. The term shall also include all heirs, assigns, successors in interest, representatives or personal representatives of the subdivider, owner, proprietor or developer. Under this definition the City is an owner and subdivider of the SMIC area and is subject to Title 16. To that end, section 16.01.015 A; covers conditions for plat approval. Section 16.01.025 restricts the issuance of building permits until public improvements are provided for. Section 16.01.030 covers the exceptions to 16.01.020 & 16.01.025. Section 16.05.010 identifies the required public improvements and section 16.05.015 gives the compliance procedures. It has been asked in the past why doesn't the City have to comply with it own subdivision regulations? There are ways to assign the cost of the required improvements that are covered in the sections of the code. To my knowledge no effort has been to explore putting in the required public improvements to the SMIC area unless another entity does it. If the City wishes to sell these lots it appears they would have to comply with the requirements of Title 16. Currently we do not have public right of ways in the SMIC, they are service roads. We have limited water, sewer and electric service in certain parts of the SMIC. This 14,000 SF site on four and two-thirds lots is Iocated at the southeast corner of Third Ave. and Jefferson St.,within the Central Business District. It is the former post office building that was remodeled and acquired from a private developer in 1988 with$866,700 public bond and grant funds. The building covers about a third of the site and currently houses the museum and the senior citizens programs.There has been some public sentiment expressing a desire for more community wide use of the facility. Recommendation: Retain ownership;_ seek way of creating more diverse community use of the building;and replat to create a single lot. General Fund (map 2-3) City Shop (Original Townsite Block 21 Lots 1-18 and 27-40). This two and a half acre parcel includes city shops, sand building, storage yard, and animal pound. The shop building was constructed under the post earthquake Urban Renewal Project.It was formally a storage yard for the power company. It includes the entire city block except for four private parcels upon which are located converted WWII Quonset huts. The 1968 and 1985 Seward Comprehensive Plans suggest that because of its size, unsurpassed views, and location near downtown and waterfront park,there may be a higher and better use for this site such as a convention center,a hotel, senior center, youth center, or multi family housing project. The land use plan designated it Urban Residential,but it remains zoned Auto Commercial to accommodate such potential uses.Thus far no suitable alternate sites have been identified that are available,affordable,or suitably located.Additionally,developers have tended to shy away from the site because of potential environmental issues related to its historical use. Recommendation:Retain land ownership,dear up titles,vacate internal lot lines. Evaluate alternative shop locations and costs.Acquire the remainder of this block to consolidate the block for either shop expansion if it remains,or to better market the site as a whole block. Market it as available for sale or trade provided there is funding from the agreement and/or other sources to replace the facilities elsewhere in the community. General Fund (map 2-4) (see Available for Lease and Acquisition) Docks, SMIC (Prelim FOJC Subd Blocks 10 and 11).Lands upon which these dock facilities are located were created from dredged tidelands during the development of the Seward Marine Industrial Center. Block 10 creates a large cargo staging area in support of the North Dock. A portion of the site needs to be contained by a breakwater and filled. Block 11 is the basin and tidelands upon which the breakwater, shiplift and future breakwater and docks will be constructed.Recommendation:Retain land and facility ownership. Complete development of Block 10 as a support area to the North Dock. Harbor Fund (map 5-1 and 5-28) Electric Substation and Water Wells 4 and 5(Fort Raymond Lot 6A). This is an±8 acre Institutional zoned site.Although it is the location of the city's electric substation,generators and two wells,there is still a heavily wooded portion that could be used for incidental uses that will not interfere with the well easements.It is part of USS 1759 which was patented to the city for cemetery purposes. It borders the cemetery and the high school ball field.Recommendation: Retain land ownership for wells and generator/sub station. Use land for other incidental uses such as ball field parking which will not interfere with well easements. The parking lot to the south includes a single lot owned by the non-profit volunteer fire department.They also own the three lots on the north side of the fire hall. As fire trucks become larger and heavier, the building becomes less useable.The Fire Master Plan recommends a new station be constructed in the mid-town area to be more centrally located within the community. New fire equipment will most likely necessitate an addition and/ or structural improvements to the building. Should the fire department be relocated,the site has been discussed _.... for a public safety building and fora teen center. If this property was sold, there would be concern about a new owner infringing on City of Seward property (vehicle parking, materials, vessel storage) and disrupting Travelift operations. Also, parcel contains a 20' P.U.E (utility easement) through the parcel, and 10' Utility easement on the north side of the parcel.
