The following is an analysis of potential options. The following land was purchased for the Levee Project: North Forest Acres Subdivision, Lots TRACTS 1,2,3,4,5, AV,AU, AW, DA, DB, DC, DE, DF, DG,MM, RR, SS, QQ. Restrictive covenants, subsequent land sales and within the active floodplain: • The City agreed with the US Army Corp of Engineers on restrictive covenants preventing development were recorded 2009-000580-0 on 5/15/2009 for the following properties: North Forest Acres Subdivision Lots TRACT 4, DB, DC, DE, DF, DG, RR, SS, QQ • Lots AU and ZZ were sold in 2010 with a public use easement placed on the levee portion. • North Forest Acres Tract 1-3 and north half of Tract 5 contain the active floodplain. Remaining Available Land North Forest Acres Lots AV, AW, DA, MM and the southern portion of Tract 5. July 25, 2011 These lots contain part of the North Forest Road Levee. The final post-construction Levee As-built will provide the City of Seward with a final determination of what portion of the lots are available to be sold. If made available to the public for sale,public easements for the portions of the levee on the parcels would need to be completed. Additionally, Tract 5 would need to be subdivided into 2 parcels to facilitate sale of the southern portion below the levee. Finally, all development on these lots would be required to obtain Floodplain development permits and adhere to the associated permit requirements. The following is an analysis of potential options. The following land was purchased for the Levee Proiect: North Forest Acres Subdivision, Lots TRACTS 1,2,3,4,5, AV,AU,AW, DA, DB, DC, DE, DF, DG,MM,RR, SS, QQ. Restrictive covenants, subsequent land sales and within the active floodplain: • The City agreed with the US Army Corp of Engineers on restrictive covenants preventing development were recorded 2009-000580-0 on 5/15/2009 for the following properties: North Forest Acres Subdivision Lots TRACT 4, DB, DC, DE, DF, DG, RR, SS, QQ • Lots AU and ZZ were sold in 2010 with a public use easement placed on the levee portion. • North Forest Acres Tract 1-3 and north half of Tract 5 contain the active floodplain. Remaining Available Land North Forest Acres Lots AV, AW, DA, MM and the southern portion of Tract 5. July 25, 2011 These lots contain part of the North Forest Road Levee. The final post-construction Levee As-built will provide the City of Seward with a final determination of what portion of the lots are available to be sold. If made available to the public for sale,public easements for the portions of the levee on the parcels would need to be completed. Additionally, Tract 5 would need to be subdivided into 2 parcels to facilitate sale of the southern portion below the levee. Finally, all development on these lots would be required to obtain Floodplain development permits and adhere to the associated permit requirements.
