Murray-Leirer, Harold and Susan Faust. has submitted for review and recommendation a preliminary plat to be known as Dairy Hill Subdivision & Cliff Addition to Seward Townsite 2017 Addition, Leirer Faust Replat; and WHEREAS, this platting action is a replat of Tracts 1, 2, 3, and 4 of Dairy Hill Subdivision Tracts 1-5, Lots 3-5 Block 5 Cliff Addition to Seward Townsite, and Lot IA Block 5 Cliff Addition to Seward Townsite Faust replat., vacating interior lot lines creating three (3) lots to be known as Lot 1 B Block 5, Cliff Addition, containing approximately 63,641 square feet, Tract 2A, Dairy Hill Subdivision, containing approximately 41,033 square feet, and Tract 4A, Dairy Hill Subdivision, containing approximately 70,697 square feet; and WHEREAS, this replat will vacate the undevelopable North/South alley Right -of -Way (ROW), and add a 10 foot utility easement on Raving Street, Vista Avenue and First Avenue; and WHEREAS, this platting action will be asking for exceptions to the following borough subdivision platting codes KPB 20.30.120 Right of Way (ROW) width — Vista Avenue, KPB 20.30.150 Right of Way (ROW) width — Ravina Street and Vista Avenue, KPB 20.30.230 Lots Double Frontage, KPB 20.30.100 Cul-De-Sacs; and WHEREAS, the owners have worked with the Electric Department to complete the required electric improvements; other utilities are available within the adjacent rights -of -way; therefore no additional subdivision agreement is required; and WHEREAS, the area included within this replat is currently zoned Single Family Residential (R1), this replat does not create any non -conforming structures or lots within the current zoning district; and WHEREAS, City staff have reviewed, commented and support the proposed Dairy Hill Subdivision & Cliff Addition to Seward Townsite 2017 Addition, Leirer Faust Replat; and CITY OF SEWARD, ALASKA RESOLUTION 2018-002 WHEREAS, as required by Seward City Code § 16.01.015, Conditions to plat approval, property owners within 300 feet of the requested replat were notified of the proposed subdivision, and the property was posted with public notice signage. WHEREAS, in accordance with Seward City Code, the Planning and Zoning Commission held a public hearing on December 5, 2017 and approved Resolution 2017-16, recommending Seward City Council and Kenai Peninsula Borough approval of the Leirer- Faust replat. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA that: Section 1. The Seward City Council recommends that, in accordance with Seward City Code Section 16.01.015 (A), the Kenai Peninsula Borough Planning Commission approves the submittal of the Dairy Hill Subdivision & Cliff Addition to Seward Townsite 2017 Addition to the Kenai Peninsula Borough and recommend approval. Section 2. The Seward City Council further recommends that the Kenai Peninsula Borough Planning Commission approve the vacation of the alley Right -of -Way as proposed by the Dairy Hill Subdivision & Cliff Addition to Seward Townsite 2017 Addition, Leirer Faust Replat. Section 3. The Seward City Council further recommends that the Kenai Peninsula Borough Planning Commission approve 10 foot Utility easement on Ravina Street, Vista Avenue and First Avenue as proposed by the Dairy Hill Subdivision & Cliff Addition to Seward Townsite 2017 Addition, Leirer Faust Replat. Section 4. The Seward City Council further recommends Kenai Peninsula Borough Planning Commission approval of the Dairy Hill Subdivision & Cliff Addition to Seward Townsite 2017 Addition, Leirer Faust Replat. Section 5. This resolution shall take effect thirty (30) days after passage and posting, as required by Seward City Code § 7.05.145. Murray-Leirer, Harold and Susan Faust. This platting action is a replat of Tracts 1, 2, 3, and 4 of Dairy Hill Subdivision Tracts 1-5, Lots 3-5 Block 5 Cliff Addition to Seward Townsite, and Lot IA Block 5 Cliff Addition to Seward Townsite Faust replat., creating three (3) lots to be known as Lot 113 Block 5, Cliff Addition, containing approximately 63,641 square feet, Tract 2A, Dairy Hill Subdivision, containing approximately 41,033 square feet, and Tract 4A, Dairy Hill Subdivision, containing approximately 70,697 square feet The replat is located northeast of the Vista Avenue and Ravina Street intersection, within the Single Family Zoning District. This platting action will vacate all interior lot lines, and vacate the 20-foot alleyway and add a 10-foot utility easement Ravina Street, Vista Avenue and First Avenue. SUBDIVISION REVIEW: Zonin : This replat is located within the Single Family Zoning District. All properties surrounding this replat are also within the Single Family Zoning District. Utilities: City sewer is more than 200 feet from the property corner and approximately 550 feet from the proposed property access site. The applicant has worked with the City, met all the code requirements and agreed to the conditions of an onsite utility permit. The applicant continues to work with the City electric department to complete the electric service extension. I% Public water and other utilities are available within the adjacent rights -of -way; therefore, no additional subdivision agreement is required. Existing Uses: Tract 4A, contains a single family home. Lot 1 B Block 5 Cliff Addition has been approved for development. The surrounding parcels to the North, East and South are also undeveloped. The parcels to the Westside of Vista Avenue contain single family homes. Flood Zone: The area is not located within a Special Flood Hazard Area. Public Comment: Property owners within three hundred (300) feet of the proposed platting action were notified of Planning and Zoning public hearing. Public notice signs were posted on the property and all other public hearing requirements of Seward City Code § 15.01.040 were complied with. Staff Comment: Electric Engineer has requested that the plat show a 10' utility easement on Ravina Street, Vista Avenue and First Avenue. Staff has confirmed that the surveyor will meet all requirements before the final plat is completed. Staff has reviewed and supports the replat and the platting action vacating all interior lot lines, vacating the 20-foot alleyway and adding a 10-foot utility easement dedication on Ravina Street, Vista Avenue and First Avenue. In doing so, the applicants seek vacation of interior lot lines and easements that would lie within the newly created lots. Wilde stated that she spoke to the City electrical engineer, who specified that the 10' utility easement along Vista Avenue should extend the entire length of the lot, and that a 10' utility easement be added along Ravina Street and First Avenue and the surveyor has been notified of this requirement and has committed to making the required changes before sending the survey drawing to the Borough. Notice of public hearing being posted and published as required by law was noted and the public hearing was opened. Harold Faust, outside city, explained the reasoning behind the request to vacate the Right of Way. Faust explained that by consolidating these lots there would no longer be a need for an alleyway easement between First and Vista, and further that the topography of land would make an alleyway impractical. Ecklund asked Faust to confirm the number of lots that would result from this platting action. Faust stated that this replat would result in the creation of three individual lots. Charbonneau asked for clarification about the north -south ROW vacation. Faust stated that the north -south alley ROW was a legal requirement to connect to the east -west alleyway that Faust's earlier platting action vacated. As a result of this platting action, no public access would be needed; therefore Faust would prefer to utilize this space on his property. Ecklund confirmed that should this platting action ever be undone, public access to these lands could still be achieved via Vista Avenue. Steve Leirer, inside city, stated that the ROW Faust was required to maintain was to access lots that Leirer owned. This platting action would no longer require that access. Leirer discussed topography of this land, making suitable build sites difficult to locate and further necessitating this platting action. Anderson asked Leirer if he had an on -site septic system, which Leirer affirmed. Ecklund asked Faust if he was installing an on -site septic system, which Faust affirmed, and has already installed. Wilde stated that the electric department will want to discuss matters relating to electrical loads with the applicant during the building permit phase, but had no comment regarding building height. Wilde stated that the Fire Department asked for a requirement that the applicant not place any items for storage above two stories, recognizing that the variance to the building height requirement is only to accommodate the 300 ton travel lift and tall vessels, but shall not be used for equipment or materials storage. The Fire Department also requested the addition of entries adjacent to both frontage streets for safety reasons. Wilde stated that the applicant has volunteered to install a fire suppression sprinkler system, which is not a typical requirement for this building type. Carol Griswold, inside city, stated her concern that this will open up floodgate for many more additional variance requests of this type. Griswold stated that she is concerned that this may cause insurance rates to increase. Griswold requests that future applicants be required to install fire suppression systems as a condition of their variance.
