RESOLUTION 2003-024
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, APPROPRIATING $8,423.00 FROM THE HARBOR ENTERPRISE
FUND RETAINED EARNINGS ACCOUNT TO THE HARBOR
ENTERPRISE FUND OPERATING BUDGET TO PAY A CLAIMS
SETTLEMENT
WHEREAS, a person using the public showers at the harbor building was injured after
slipping in the shower; and
WHEREAS, the injured person filed a claim with the City of Seward, which was
ultimately settled for $8,423.00, which is below the deductible for our insurance coverage; and
WHEREAS, past administration policy would have allowed insurance reserves to cover
this settlement amount, however, the reserves have not received any funds for several years and
is unable to continue funding settlements in this manner; and
WHEREAS, the Harbor Enterprise Fund was developed as a no-growth budget for 2003
and does not have funds programmed for this contingency; and
WHEREAS, absorbing this claim into the current operating and maintenance budget will
have an adverse impact on planned maintenance and repair activities.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEWARD, ALASKA, that:
Section 1. $8,423.00 is appropriated from the Harbor Enterprise Fund Retained Earnings
Account 401-0000-3050 to the Harbor Enterprise Fund Account 401-4360-5790 to pay for the
claims settlement.
Section 2. This resolution shall take effect immediately upon adoption.
PASSED AND APPROVED by the City Council of the City of Seward, Alaska, this
10th day of March 2003.
