CITY OF SEWARD, ALASKA RESOLUTION NO. 784 RESOLUTION PROVIDING FOR LEASE AND LICENSE. WHEREAS, the City of Seward is the owner of the Fourth Avenue Dock and that structure commonly known as the Old Depot Building at the foot of Fourth Avenue, and WHEREAS, the ordinances of the City of Seward pro- vide for the sale or other disposition of real property owned by the City of Seward, which is not dedicated to any public use, and the subject property is not dedicated to any public use, and WHEREAS, the ordinances provide that the Council may, by motion passed, find that the public interest will not be served by license or lease of said subject property, either by auction or sealed bid, and WHEREAS, the lease and license agreement between the City of Seward and Northern Stevedoring and Handling Corporation specifically provides for the lease and license which is the subject of this resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA: Section 1. That it is in the public interest to grant the license and lease of the property herein described to the State of Alaska, and that all provisions with reference to public advertisement for lease or license of the subject property are hereby declared to be not in the public interest. That the City Manager is authorized and directed to negotiate the lease and license agreement of said property in accordance with the ordinances of the City of Seward and the proposals of the State of Alaska, and to do all things necessary to consummate said lease, and the proper City officials are authorized and directed to execute the lease. Section 3. That this Resolution shall be filed and published as in the case of resolutions for public sale of property, and the lease and license agreement shall not be executed until said Resolution, along with the proposed lease and license agreement, has been on file in the office of the Clerk for thirty (30) days.
