<br />I <br /> <br />I <br /> <br />I <br /> <br />Sponsored by: Janke <br /> <br />CITY OF SEWARD, ALASKA <br />RESOLUTION NO. 2002- 004 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, <br />ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO AN <br />AGREEMENT WITH TRANSP AC MARINAS, INCORPORATED FOR THE <br />PURCHASE OF 100 SAFETY LADDERS FOR AN AMOUNT NOT TO <br />EXCEED $18,800. <br /> <br />WHEREAS, a large portion of the harbor float system was replaced during the recent <br />renovation project and to save on installation and project costs, several items were left f@r future <br />additions and/or projects; and <br /> <br />WHEREAS, one ofthese critical issues is the procurement and installation of safety ladders <br />required by the Occupational Safety and Health Administration regulations for worker safety; and <br /> <br />WHEREAS, these ladders are also necessary for the safety of customers in the harbor; and <br /> <br />WHEREAS, the harbor staff researched many types ofladders constructed of many types of <br />materials and contacted several vendors, manufacturers and sources of ladders; and <br /> <br />WHEREAS, Transpac Marinas, Incorporated offered to take a look at the issue and designed <br />a galvanized steel ladder, incorporating the existing bolt holes and design ofthe float system into the <br />concept; and <br /> <br />WHEREAS, a prototype was ordered, installed and tested and found to be of superior <br />quality, function and design; and <br /> <br />WHEREAS, per City of Seward Code of Ordinances S6.1 0.120, this purchase is exempt <br />from competitive procurement procedures for two reasons; it is a proprietary design of one company <br />and is therefore manufactured by only one source, and it is a patented item. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF TH~ CITY <br />OF SEWARD, ALASKA, that: <br /> <br />Section 1. The City Manager is authorized to enter into an agreement with Transpac <br />Marinas, Incorporated for the purchase of 100 safety ladders for an amount not to exceed <br />$18,800. <br /> <br />Section 2. This purchase is exempt from competitive procurement procedures <br />because the item is a patented design and available only from one vendor. <br />
