HomeMy WebLinkAboutRes2001-025 I I I Sponsored by: Janke CITY OF SEWARD, ALASKA RESOLUTION 2001-025 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO ADJUST THE ALASKA RAILROAD CORPORATION'S WATER BILL FROM $10.00 PER 1,000 GALLONS TO $4.25 PER 1,000 GALLONS RETROACTIVE TO MAY 1, 1998 AND ISSUE A REFUND FOR THE OVERPAYMENT OF $24,127.78 WHEREAS, Council approved a ship water tariff for temporarily moored vessels at $3.03 per 1,000 gallons effective July 1, 1993; and WHEREAS, due to additional costs of manpower for delivering water to temporarily moored vessels, Council approved a ship water tariff for temporarily moored vessels at $10.00 per 1,000 gallons effective May 1, 1995; and WHEREAS, the water rate for the Alaska Railroad Corporation's (ARRC) cruise ship water was not changed to the $10.00 rate until May 1, 1998 after a routine review of customers' bills revealed that the ARRC's ship water rate had not been changed in 1995; and WHEREAS, the ARRC disputed the new water rate of$10.00 per 1,000 gallons in 1998; and WHEREAS, it was not the City's intention to change the ARRC's water rate when the rate for temporarily moored vessels was changed to $10.00 as the ARRC has a direct water connection that does not require additional manpower; and WHEREAS, a new rate study approved by Council established a new ship water tariff of $4.25 with additional charges for any assistance required for temporarily moored vessels effective May 1, 1999; and WHEREAS, based on the ship water rate study conducted in 1999 that set the rates for ship water at $4.25 per 1,000 gallons, the administration has reached an agreement with the ARRC that would require the ARRC to pay the $4.25 rate from May, 1998 instead of the $10.00 rate; and WHEREAS, the agreement between the City and the ARRC is fair and equitable and charges the rate based on a the most recent rate study that has determined that the City will recover it's costs for ship water from the ARRC at the new rate of$4.25 per 1,000 gallons. CITY OF SEWARD, ALASKA RESOLUTION 2001-025 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. Council authorizes the city manager to adjust the Alaska Railroad Corporation's water bill from $10.00 per 1,000 gallons to $4.25 per 1,000 gallons retroactive to May 1, 1998 and issue a refund for the overpayment of$24,127.78. Section 2. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 12th day of February, 2001.
