Proclcunation WHEREAS; sexual assault is a violent and devastating crime that affects women, men, and children of all racial, cultural, and economic backgrounds; and WHEREAS, the repercussions of sexual assault reach beyond the immediate physical and emotional impacts and may include post-traumatic stress disorder, substance abuse, major depression, hornelessness, eating disorders, and suicide; and WHEREAS, it is important to recognize the dedication and contributions of the individuals who provide services to sexual assault survivors and wOcrk to increase the public understanding of this alarming problem; and WHEREAS, changing societal views and holding perpetrators responsible for their violence are two enormous steps to making Alaska a safer, healthier place to live, work) and raise a family; and WHEREAS, Alaska continues to have the highest incidence of sexual assauit in the country with a rate of 2.5 times the national average. Due to the prevalence of these crimes, I encourage all Alaskans to increase their awareness and work to prevent sexual assault in all communities across Alaska; and. WHEREAS, speaking out against sexual assault is an important first step to eradicating this devastating crime. Together, united in this effort, we .can continue to make a difference. CITY OF SEWARD, ALASKA, DETERMINING THAT IT IS IN THE l't1liLICINTEREST TO WAIVE THE NORMAL BID PROCESS PER SEWARD CITY CODE ~6.IO.130 AND AUTHORIZE THE CITY MANAGER TO ENTER INTO A LEASE AGREEMENT W1THXEROX FOR THE PORPOSE OF LEASING A PUBLIC USE COPIER IN THE SEWARD COMMUNITY LmRARY WHEREAS. The Seward Community Library has consistently maintained one of the few public use copiers in Seward; and WHEREAS, the current copier lease expired in JanulU)'. 2006. and the library desires to replace the copier with a new machine with expanded capabilides; and WHEREAS, Xerox has submitted a proposed 6O-month 19ase for a copier that is wheelchair accessible, has coin operated features and includes fun service maintenance, including parts and labor, for a total monthly lease rate of $208.60, representing a total lease cost of $12,515.00 over five years, with no lump-sum payout at the end of the lease; and WHEREAS. the above lease fee includes a trade-in on the existing machine, and Xerox agrees to remove the existing equipment; and WHEREAS, the lease includes the required non-appropr1ltion clause which allows the City to terminate the lease if monies are not appropriated for any given budget year~ and WHEREAS, in addition to the lease fee, Xerox will bill the City $0.0169 per copy; and WHEREAS, funding for this project was included in thg 2006 library budget; and WHEREAS, it is in the public interest to waive the norIllal bidding process per Seward City Code ~6.1O.130 based on the following: I) the current copl.... has a higher trade-in value with Xerox; 2) Xerox will remove the current cOpier at no extra cost; 3) the quality of maintenance and repair work from Xerox is excellent given their Kenai Peninsula presence and the overwhelming number of Xerox copiers in Seward. Our current machine bas survived the end of a five year lease and the lilmuy bas negotisted a new lease on a new copier. The enclosed proposed lease agreement includes a copier that is wheelcbair accessible, bas coin operated features and full service maintenance including parts and labor for a monthly charge of $208.60 paid over the five year life of the lease totaling $12515.00. There will be an additional charge of$0.0169 per copy made, assessed monthly. The previous monthly payment included 1400 copies per month. The number of copies made monthly on the machine Was always less than 1400. The new contract takes that fact into account by having a base lease payment and additional per copy charge. Xerox bas allowed for trade in on the old machine and win remove and insta1J as part of the agreement. The lease (copies attached) is for sixty (60) months and includes the required non-appropriation clause which allows the City to terminate the lease if monies are not appropriated for any given budget year. Based on the heavy use oflbe above copier, it is recommended to trade-in the old copier for the proposed copier. It is also recommended that Council find it in the public interest to waive the normal bidding process per City Code ~ 6.1 0.103 based on the following: I) the current copier bas a higher trade in value with Xerox; 2) Xerox removes the .current copier at no extta cost; and 3) lhe maintenance level is excellent from Xerox due to their Kenai Peuinsula p1'eloellCe and lhe overwheIming number of Xerox copiers in Seward. The number of Xerox copiers in Sewan! means that the maintenance technician is usually in Seward on a weekly basis and therefore, is able to perform regular maintenance on the copier. The budget cycle is stipulated in the City's Charter, and a modification to the Charter requires a vote of the people. Therefore, we are seeking Council authorization to present a proposition to the voters at the October 3, 2006 election, in substantially the same fonn as approved at this Council meeting. This proposition seeks to modify the Charter to require a biennial rather than annual, budget. In the first year of a biennial budget process, the City Council is asked to approve the budget for the next two years. The budget for the first of the two years, becomes the Council's AUTHORIZED budget. The budget forthe second of the two years, becomes the Council's APPROVED budget. At the end of the first year, the Council and administration would engage in a thorough review of the second years' budget, making adjustments necessaJ)' to reflect unforeseen revenues and expenditures. Council approval of the modifications would then constitute the AUTHORIZED budget furyeartwo. If the voters approve the proposed Charter changes, the administration will then submit subsequent Ordinance change recommendations to the Council, to reflect the wishes of the voters, and officially modifY the City Charter. The authority vested in an animal control enforcement officer shall not be construed to provide said enforcement officer with the authority to enter a private building or dwelling house for any reason, unless permission is given by said owner of said property. Further, animal control officers shall not go op,to private property unless said officer or officers have actual knowledge of a violation of this chapter and it is necessary to enter onto the property to take a dog into custody. But, prior to pursuing a dog onto private property the animal control officer shall first seek approval. from the owner or occupant of the premises, and if permission is denied, the animal control officer shall not pursue the animal while on the private property of a person who does not give permission. To: Subj: This topic was set on the agenda by Council member Lorenz 00 Tuesday, April 4, 2006. City Attorney Cheryl Brooking and l, briefly researched this topic to pull this information together for your review: . AS29.35.020 is the state statute that speaks to certain extraterritorial powers that municipalities have. The city council cannot require action like this outside city boundaries. Some of those powers described are for utilities, fire protection, etc.. but not the ability to require people outside the city to hold elections and serve on the city council. . AS29.26.0S0 is the state statute that speaks to state voter qualitications. Only city residents can vote in a city election, so an advisory member could not be elected. . AS29.20.140 (a) requires that members of council be city residents, to therefore, be eligible to be city voters or a designated voice "on" council. . Our Charter 2.2 requires that members of council be city residents, to therefore. be eligible to be city voters. . Our Charter 2.1 limits the number of council members (mayor plus 6) so an increase would require voter approval, assuming there were no State law problems. . Council does not have the power to make an ordinance change that is contrary to the Alaska Statutes or the City Charter. . If it were assumed that this could be done under Alaska law, there would need to be other limitations beyond just property taxes, to their authority. Some of those questions that would have to be answered or addressed throughout the code are: o Advisory members could not direct the city manager, city clerk or city attorney. o Advisory members could not require items to be placed on the council agenda. o Advisory members would be excluded from all executive sessions. o This would raise questions on how would we handle advice regarding the city budget? Sales tax? Police? Fire? Utilities? Finances? Litigation? These are initial thoughts. It appears from a legal standpoint, this suggestion really cannot be implemented. If non-residents have suggestions and advice for council, I hope OUT current system and accessibility to the city council is sufficient. These were the "red flags" we found.
