HomeMy WebLinkAboutRes1991-001 Sponsored by: Schaefermever CITY OF SEWARD PLANNING AND ZONING COMMISSION RESOLUTION NO. 91-001 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, ALASKA, GRANTING A REQUEST FOR CONDITIONAL USE PERMIT TO THE KENAI PENINSULA BOROUGH FOR DEVELOPMENT OF A SOLID WASTE TRANSFER FACILITY WITHIN NE 1/4 SECTION 28 TIN RIW SEWARD MERIDIAN (TAX PARCEL 144-240-01) AS AUTHORIZED BY 15.10.320 OF THE SEWARD ZONING CODE WHEREAS, the Kenai Peninsula Borough has requested a Conditional Use Permit for development of a solid waste transfer facility within the Jap Creek/Resurrection River area within NE 1/4 Section 28 TIN RIW; and WHEREAS, an application meeting the requirements of Section 15.10.320(B) was submitted and received on January 12, 1990, with a Conditional Use Permit being issued effective February 7 to August 7, 1990; and WHEREAS, that permit expired August 7, 1990, and a new application was received on February 19, 1991; and WHEREAS, this request is located on land zoned Resource Management (RM); and WHEREAS, a duly advertised pUblic hearing, meeting the requirements of Section 15.01.040, was held by the Commission on March 6, 1991; NOW, THEREFORE, BE IT RESOLVED BY THE SEWARD PLANNING AND ZONING COMMISSION of the City of Seward that: Section 1. The proposed use satisfies the conditions specified in Section 15.10.320(D) of the Seward Zoning Code. Section 2. The City Clerk is authorized to issue a Conditional Use Permit to the Kenai Peninsula Borough for a solid waste transfer facility, on tax parcel 144-240-01, within NE 1/4 Section 28, TIN RIW SM subject to the following: a. That within three years from issuance of a building permit, the Kenai Peninsula Borough will construct an alternate access to the landfill/transfer operation site that will not be through a residential area. Section 3. This resolution shall take effect immediately upon its adoption.
