<br />Sponsored by: Schaefermeyer <br /> <br />CITY OF SEWARD <br />PLANNING AND ZONING COMMISSION <br />RESOLUTION NO. 92-003 <br /> <br />A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, <br />ALASKA, GRANTING A REQUEST FOR CONDITIONAL USE PERMIT BY ALASKA <br />DOT/PF FOR EXTRACTION AND TRANSPORTATION OF GRAVEL FROM JAP CREEK <br />WITHIN SE1/4 SECTION 28 T1N R12 SM AS AUTHORIZED BY ~15.10.320 OF <br />THE SEWARD ZONING CODE <br /> <br />WHEREAS, the Alaska Department of Transportation and Public <br />Facilities (DOT/PF) has requested a Conditional Use Permit for the <br />extraction and transportation of gravel from their material source <br />at Jap Creek through Forest Acres Subdivision to the Seward <br />Airport; and <br /> <br />WHEREAS, an application meeting the requirements of Section <br />15.10.320(B) was submitted and received on January 15, 1992; and <br /> <br />WHEREAS, this request is located on land zoned Resource <br />Management; and <br /> <br />WHEREAS, a duly advertised public hearing, meeting the <br />requirements of Section 15.01.040, has been held by the Commission <br />on February 5, 1992. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE SEWARD PLANNING AND ZONING <br />COMMISSION of the City of Seward that: <br /> <br />Section 1. The proposed use satisfies the conditions specified <br />in Section 15.10.320(D) of the Seward Zoning Code. <br /> <br />Section 2. The City Clerk is authorized to issue a Conditional <br />Use Permit to the Alaska Department of Transportation and Public <br />Facilities for the extraction of ~40,OOO cubic yards of gravel from <br />DOT/PF MS No. 31-1-606-1 and transport of same over public streets <br />subject to the following conditions: <br /> <br />1. Because of spring breakup and the residential <br />construction standards of the road, load limits will be <br />the same as those in effect on the state highway. <br /> <br />2. Flag persons will be used at a designated school crossing <br />intersection during the hours of 7:30 a.m. to 8:30 a.m. <br />and 3:00 p.m. to 4:00 p.m. <br /> <br />3. Representatives of the City and DOT/PF will inspect and <br />document the haul route prior to and immediately after <br />the hauling operation. DOT/PF will repair any damage <br />created by the hauling operation up to and including <br />overlay and rebuilding if necessary. <br />
