HomeMy WebLinkAboutRes1994-006 Sponsored by Tones CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 94-006 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, GRANTING A SIX-MONTH CONDITIONAL USE PERMIT EXTENSION TO BRAD SNOWDEN FOR DEVELOPMENT AND OPERATION OF A HOTEL ON ALASKA RAILROAD RIGHT- OF-WAY WITHIN THE SMALL BOAT HARBOR AS AUTHORIZED BY ~ 15.10.320E. OF THE SEWARD ZONING CODE WHEREAS, Brad Snowden requested and was granted a Conditional Use Permit by Resolutions No. 93-012 and No. 93-013 for development and operation of a hotel on Alaska Railroad Right-of-Way within the Small Boat Harbor areaj and WHEREAS, Mr. Snowden has negotiated a lease for the use of Alaska Railroad property for development of a hotelj and WHEREAS, through no fault of Mr. Snowden, the discovery, study and cleanup of contaminated soils on the site has caused the lease and project to be placed on holdj and WHEREAS, Mr. Snowden has requested a six-month extension of his Conditional Use Permit to provide time for the Alaska Railroad to resolve the land cleanup process, subsequent to signing of the lease with Mr. Snowden and commencement of the hotel projectj and WHEREAS, ~ 15.10.320 E. of the Seward Zoning Code allows the Planning Commission to grant extensions not to exceed six months upon a finding that the circumstances have not changed sufficiently to warrant a reconsideration of the approval of the Conditional Use Permitj NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. Circumstances have not changed sufficiently to warrant a reconsidera- tion of the approval of the Conditional Use Permit granted to Mr. Brad Snowden for development of a hotel on Alaska Railroad property within the Seward Small Boat Harbor. Seward Planning and Zoning Commission Resolution No. 94-006 Section 2. Brad Snowden is hereby granted a six-month extension through September 1, 1994, of the Conditional Use Permit authorized by Seward Planning and Zoning Commission Resolutions No. 93-012 and No. 93-013. Section 3 This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the Seward Planning and Zoning Commission this 6th of April, 1994.
