HomeMy WebLinkAboutRes1994-008 Sponsored by Jones CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 94-008 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, GRANTING A REQUEST FOR VARIANCE TO SEWARD SHIP'S DRYDOCK, INC. FOR EXCEPTION TO THE BUILDING HEIGHT AND FRONT SET BACK LIMITATIONS ON WT 1, BWCK 7, SEWARD MARINE INDUSTRIAL CENTER (PRELIMINARY PLAT) AS AUTHORIZED BY f 15.10.325 OF THE SEWARD ZONING CODE WHEREAS, Seward Ship's Drydock, Inc. has requested a variance for relief from the maximum building height and front set back limitations in the Industrial zone on Lot 1, Block 7, Seward Marine Industrial Center Preliminary Plat; and WHEREAS, an application meeting the requirements set forth in ~ 15. 10. 325 (B) of the Seward Zoning Code was submitted and received on May 10, 1994; and WHEREAS, this request for a variance is on land located in the Industrial zone; and WHEREAS, the request is in conjunction with the applicant's city lease requirement to construct a permanent covered repair building capable of fully enclosing a vessel 300 feet in length; and WHEREAS, a duly advertised public hearing, meeting the requirements set forth in ~ 15.10.040, was held by the Planning Commission on June 1, 1994; NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. The proposed use satisfies the conditions specified in SCC ~ 15.l0.325(D). Section 2. The City is authorized to issue a variance permit to Seward Ship's Drydock, Inc. allowing for the construction of a ship repair drydock building cover with a maximum building height not to exceed 105 feet, on city lease site RE-88-073, and identified on the preliminary plat of the Seward Marine Industrial Center as Lot 1, Block 7, subject to the following conditions: 1. Issuance of a building permit by the Alaska State Fire Marshal based upon a non-structural review. Seward Planning and Zoning Commission Resolution No. 94-008 2. Issuance of a city of Seward building permit based on a full, structural and non-structural review. 3. Adherence to any and all conditions of the building permit. 4. Establishment of a 20 foot clear zone around the building to provide fire access and a snow shed area. 5. Required additional fire hydrants and associated water lines to be located along lease property lines. 6. Applicant removes the trailer office in accordance with the Conditional Use Permit issued 5/03/89. Section 3. The City is authorized to issue a variance permit to Seward Ship's Drydock, Inc. allowing for the construction of a ship repair drydock building cover inside the 20 foot front yard setback, but no closer than 4 feet 6 inches to the front property line of city lease site RB- 88-073 and identifIed on the preliminary plat of the Seward Marine Industrial Center as Lot 1, Block 7, and subject to the following conditions: 1. Applicant relocates the 10" water main off the lease site, as shown on the site plan submitted for permit approval. The two fire hydrants located on applicant's lease site may remain in place subject to a utility easement placed around them. 2. Applicant relocates sewer cleanout to the outside of the building and assumes responsibility for that portion of the 8 inch sewer line located within applicant's leased parcel. 3. There will be no floor drains within the building connected to the city sewer system. 4. Applicant to submit a revised site plan showing employee and customer parking, including access, signage and what other measures will be implemented to ensure the parking area is not used for other purposes. 5. Applicant will paint the roof and the building a neutral color (brown or gray) to blend in with the surrounding area. Section 4. This resolution shall take effect immediately upon its adoption.
