HomeMy WebLinkAboutRes1994-013 Sponsored by Jones CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 94-013 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, APPROVING A REQUEST FOR CONDmONAL USE PERMIT AS REQUESTED BY WALTER RICHARD YAEGER FOR A FAST FOOD WAGON ON WT 33, BLOCK 9, ORIGINAL TOWNSITE AS AUTHORIZED BY ~ 15.10.320 OF THE SEWARD ZONING CODE WHEREAS, Walter Richard Yaeger has requested a Conditional Use Permit for operation of a self-contained fast food wagon to be located on Lot 33, Block 9, Original Townsite, which is zoned Central Business District (CBD); and WHEREAS, drive-in fast-food restaurant services are allowed in the Central Business District by Conditional Use Permit; and WHEREAS, an application meeting the requirements set forth in ~ 15. 10. 320(B) of the Seward Zoning Code was received by Yaeger on June 20, 1994; and WHEREAS, a duly advertised public hearing, meeting the requirements set forth in ~ 15.01.040 of the Seward Zoning Code was held by the commission on July 6, 1994; NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. The proposed use satisfies the conditions specified in ~ 15.10.320(0) of the Seward Zoning Code. Section 2. The City Clerk is hereby authorized to issue a Conditional Use Permit to Walter Richard Yaeger for operation of a self-contained fast-food trailer on Lot 33, Block 9, Original Townsite to expire on September 30, 1994 subject to the following conditions: 1. Applicant must provide documentation specifying the location of restrooms. 2. The unit is not to be "hard connected" to any city utility services but applicant must obtain temporary electric service from the Seward Public Utilities for the duration of the permit. 3. Any signs attached to the trailer or installed on the site must conform to provisions of the Seward Sign Code. Portable signs shall not be allowed. 4. The operator shall provide on-site parking for employees and at least two customer parking spaces. Seward Planning and Zoning Commission Resolution No. 94-013 5. Applicant must be in possession of a city business license. Section 3. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the Seward Planning and Zoning Commission this 6th day of July, 1994.
