HomeMy WebLinkAboutRes1994-020 Sponsored by Jones CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 94-020 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, GRANTING A SECOND SIX MONTH EXTENSION TO THE CONDITIONAL USE PERMIT ISSUED TO BRAD SNOWDEN FOR DEVELOPMENT AND OPERATION OF A HOTEL ON ALASKA RAILROAD RIGHT OF WAY WITHIN THE SMALL BOAT HARBOR WHEREAS, Brad Snowden was granted a Conditional Use Permit in September 1993 for development and operation of a hotel on Alaska Railroad right-of-way within the small boat harbor area; and WHEREAS, Brad Snowden has negotiated a lease for the use of Alaska Railroad property for development of a hotel; and WHEREAS, through no fault of Mr. Snowden, the hotel project and the lease with the railroad is pending due to the discovery, study and needed clean-up of contaminated soil at the site; and WHEREAS, Brad Snowden received a six month extension approved by the Planning Commission on April 6, 1994, in order to provide time for the Alaska Railroad to resolve the land clean-up process, subsequent signing of the lease and commencement of the hotel project; and WHEREAS, Brad Snowden has requested another six month extension of his CUP to provide additional time for the Alaska Railroad to resolve the above issues; and WHEREAS, the Alaska Railroad is in support of the request for extension in order to resolve the land contamination issue with the Alaska Department of Environmental Conservation; and WHEREAS, SCC ~ 15.1O.320E allows the Planning Commission to grant extensions not to exceed six months upon a finding that the circumstances have not changed sufficiently to warrant a reconsideration of the approval of the CUP; NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. The circumstances have not changed sufficiently to warrant a reconsidera- tion of the approval of the CUP issued to Brad Snowden for development of a hotel on Alaska Railroad property within the Seward small boat harbor. Seward Planning and Zoning Commission Resolution No. 94-020 Section 2. A six month extension through March 1, 1995, to the CUP, is hereby granted to Brad Snowden. Section 3. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the Seward Planning and Zoning Commission this 7th day of September, 1994.
