HomeMy WebLinkAboutRes1995-007 Sponsored by Staff CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 2S:01 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, APPROVING A LIMITED CONDITIONAL USE PERMIT TO GILBERT KNIGHTEN DBA GIL'S GOODIES FOR OPERATION OF A SELF-CON- T AINED FAST FOOD VAN ON LOT 8, BLOCK 3, OCEANVIEW SUBDIVISION THROUGH SEPTEMBER 30, 1995, AS AUTHORIZED BY ~ 15.10.320 OF THE SEWARD ZONING CODE WHEREAS, Gilbert Knighten submitted a request for a Conditional Use Permit to operate a self-contained fast food van on Lot 8, Block 3, Oceanview Subdivision which is zoned Central Business District (CBD); and WHEREAS, transient merchants are allowed 10 the Central Business District by Conditional Use Permit; and WHEREAS, an application meeting the requirements set forth in ~ 15.10.320 (B) of the Seward Zoning Code was submitted and received on February 27, 1995; and WHEREAS, a duly advertised public hearing, meeting the requirements set forth in ~ 15.01.040 was held by the Planning and Zoning Commission on April 5, 1995; NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. The proposed use satisfies the conditions specified in ~ 15.10.320 (D) of the Seward Zoning Code. Section 2. The City Clerk is authorized to issue a Conditional Use Permit to Gilbert Knighten dba Gil's Goodies for operation of a self-contained fast food van on Lot 8, Block 3, Oceanview Subdivision for a period ending on September 30, 1995, subject to the following conditions: 1. The unit is to be totally self-contained and not "hard" connected to city utilities. 2. The tires must be blocked and the van fully skirted. 3. The operator shall maintain the site free of litter at all times through the use of on- site covered trash receptacles and be responsible for disposing of the rubbish accumulated in the receptacle in accordance with SCC ~ 14.05. 4. The operator will provide at least three on-site parking spaces. Seward Planning and Zoning Commission Resolution No. 95-07 5. The operator is required to ensure that the mobile unit maintains at least a 10 foot setback from any property line, building or other transient merchant. 6. Advertising shall be limited to a maximum area of 20 percent of the wall surface of anyone wall. In accordance with the local sign code, portable and off-premise signs are prohibited. Section 3. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the Seward Planning and Zoning Commission this 5th day of April, 1995.
