HomeMy WebLinkAboutRes1997-011 Sponsored by Staff CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 97-11 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, GRANTING A SIXTH MONTH EXTENSION OF THE CONDITIONAL USE PERMIT ISSUED TO MICHAEL ENDRES FOR THE DEVELOPMENT OF TWO FOUR-PLEXES ON LOTS 5 AND 6, JESSE LEE HEIGHTS SUBDIVISION, ADDITION NO.3 WHEREAS, on November 6, 1996, the Commission approved Resolution No. 96-18, granting Michael Endres a Conditional Use Permit for the construction of two four-plexes on Lots 5 and 6, Jesse Lee Heights Subdivision, Addition No.3; and WHEREAS, on March 12, 1997, Mr. Endres applied for a variance to reduce the off- street parking requirements in order to accommodate city utilities; and WHEREAS, on May 7, 1997, the Commission approved Resolution No. 97-06, granting Mr. Endres a parking variance to allow for the proposed development; and WHEREAS, SCC 15.10.320, E. stipulates that an approved conditional use permit lapses six (6) months after approval if no building permit is procured or if the allowed use is not initiated and allows the Planning and Zoning Commission to grant extensions not to exceed six months each upon a finding that the circumstances have not changed sufficiently to warrant a reconsideration of the approval of the Conditional Use Permit; and WHEREAS, Mr. Endres has requested an extension of the Conditional Use Permit in order to continue with the development of the project. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. Circumstances do not appear to have changed sufficiently to warrant a reconsideration of the approval of the Conditional Use Permit granted to Michael Endres for development of two four-plexes on Lots 5 and 6, Jesse Lee Heights Subdivision, Addition No. 3. Section 2. Michael Endres is hereby granted a six-month extension through November 6,1997, of the Conditional Use Permit authorized by Seward Planning and Zoning Commission Resolution No. 96-10. Section 3. This resolution shall take effect immediately upon its adoption.
