<br />Sponsored by Staff <br /> <br />CITY OF SEWARD, ALASKA <br />PLANNING AND ZONING COMMISSION <br />RESOLUTION NO. 97-14 <br /> <br />A RESOLUTION OF THE SEWARD PLANNING AND ZONING <br />COMMISSION, ZONING CODE INTERPRETATION REGARDING D'ROSE <br />JEWELRY LOCATED AT 1603 LEIRER ROAD, WITHIN THE <br />INDUSTRIAL ZONING DISTRICT <br /> <br />WHEREAS, Cindy Waliezer is the owner ofD'Rose Jewelry, a jewelry/gift retail store <br />located at 1603 Leirer Road and further identified by Kenai Peninsula Borough Tax Parcel No. <br />145-250-17; and <br /> <br />WHEREAS, according to the official City of Seward Zoning Map, the property is located <br />within the Industrial Zoning District; and <br /> <br />WHEREAS, according to the Seward Zoning Code, Land Uses Allowed Table 15.10.225, <br />only industrial related retail sales and services businesses are allowed in the Industrial Zoning <br />District; and <br /> <br />WHEREAS, non-industrial retail sales and service businesses are allowed outright in the <br />Office Residential, Auto Commercial, Central Business and Harbor Commercial Districts; and <br /> <br />WHEREAS, on May 6, 1997, the Community Development Department sent Ms. <br />Waliezer a letter informing her of the violation and requesting that she cease operation of the <br />jewelry/gift store in the Industrial District by June 6, 1997; and <br /> <br />WHEREAS, in a letter dated June 3, 1997, Ms. Waliezer appealed the Community <br />Development Director's decision to the City Manager; and <br /> <br />WHEREAS, the City Manager concurred with the Community Development Director that <br />D'Rose Jewelry was not an allowed use in the Industrial District; and <br /> <br />WHEREAS, in a letter dated June 27, 1997, Ms. Waliezer appealed the administration's <br />decision to the Planning and Zoning Commission; and <br /> <br />WHEREAS, the Planning and Zoning Commission is the body created to assist in the <br />interpretation of the Seward Zoning Code. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning <br />Commission that: <br />
