HomeMy WebLinkAboutRes1997-020 Sponsored by Staff CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 97-20 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, GRANTING A SIX MONTH EXTENSION OF THE CONDITIONAL USE PERMIT ISSUED TO BRAD SNOWDEN FOR THE DEVELOPMENT OF A HOTEL ON ALASKA RAILROAD LEASE LAND IN THE HARBOR COMMERCIAL DISTRICT WHEREAS, on September 4, 1996, the Planning & Zoning Commission issued an amended conditional use permit to Brad Snowden for the development and operation of a hotel on Alaska Railroad lease property in the Small Boat Harbor; and WHEREAS, the Zoning Code stipulates that an approved conditional use permit lapses six (6) months after approval if no building permit is procured or if the allowed use is not initiated; and WHEREAS, SCC ~ 15.10.320 (E) states that the Commission may grant time extensions not to exceed six months each upon a finding that circumstances have not changed sufficiently to warrant a reconsideration of the approval of the CUP; and WHEREAS, P&Z Resolution No. 97-08 Substitute, granted the permittee a six month extension of the CUP until November 7, 1997; and WHEREAS, on November 7, 1997, Mr. Snowden requested an additional six month extension of the permit; and WHEREAS, although a building permit has not been procured and the conditional use has not been initiated, Mr. Snowden has stubbed water and sewer to the property, and relocated and paved a portion of Fourth A venue to accommodate the hotel project; and WHEREAS, Mr. Snowden has also submitted preliminary plans and the building permit application fee to the City, however, according to an April 25, 1997, letter from Dave Calvert, Manager of Engineering and Utilities, that application and fee will expire on January 9, 1998; NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. Circumstances have not changed sufficiently to warrant reconsideration of the Conditional Use Permit as amended and issued to Brad Snowden on September 4, 1996.
