HomeMy WebLinkAboutRes1998-002 Sponsored by Staff CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 98-02 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMIS- SION, GRANTING A SIX MONTH EXTENSION OF THE CONDITIONAL USE PERMIT AND BUILDING SETBACK VARIANCE ISSUED TO JAMES MCCRACKEN FOR THE DEVELOPMENT OF AN EIGHT UNIT, MULTI- FAMILY DWELLING ON LOTS 21-24, BLOCK 12, ORIGINAL TOWNSITE OF SEWARD WHEREAS, on August 6,1997 the Planning & Zoning Commission granted a conditional use permit and variance to Jim McCracken for the development of an eight unit, multi-family dwelling on Lots 21-24, Block 12, Original Townsite of Seward; and WHEREAS, Approval of Resolution No. 97-15 on September 3, 1997 ratified the decision; and WHEREAS, the Zoning Code stipulates that an approved conditional use permit lapses six (6) months after approval if no building permit is procured or if the allowed use is not initiated; and WHEREAS, SCC ~ 15.10.320 (E) states that the Commission may grant time extensions not to exceed six months each upon a finding that circumstances have not changed sufficiently to warrant a reconsideration of the approval of the CUP; and WHEREAS, on January 14, 1998 Mr. McCracken submitted a written request for a six month extension of the approved conditional use permit and variance; and WHEREAS, in his January 13, 1998 letter Mr. McCracken stated that he has installed water and sewer inside the lot lines, and that the vacation of the lot lines is in the final stages. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. Circumstances have not changed sufficiently to warrant reconsideration of the Conditional Use Permit and Variance issued to James McCracken on September 3, 1997. Section 2. The Conditional Use Permit and Variance issued to James McCracken on September 3, 1997, is hereby extended until September 3, 1998. Section 3.
