RESOLUTION NO. 2&08
A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, GRANTING A SIX MONTH EXTENSION OF THE
VARIANCE PERMIT ISSUED TO DIANE AND JOE OWENS FOR THE
DEVELOPMENT OF A SINGLE FAMILY DWELLING ON LOT llA,
PARK PLACE SUBDIVISION
WHEREAS, on November 5, 1997 the Planning & Zoning Commission approved
Resolution No. 97-19, which granted Diane and Joe Owens a variance to reduce the required 20
foot front yard setback to five feet, and waive the minimum buildable lot size requirement of
6,000 square feet, for the development of a single-family residence on Lot 11A, Park Place
Subdivision; and
WHEREAS, the Zoning Code stipulates that an approved variance permit lapses six (6)
months after approval if the variance for which the permit was issued has not been implemented;
and
WHEREAS, SCC ~ 15.10.320 (E) states that the Commission may grant a time extension
not to exceed six months upon fmding that circumstances have not changed sufficiently since the
date of initial permit approval; and
WHEREAS, on April 8, 1998, the Community Development Department received a
written request from Mr. & Mrs. Owens for a six month extension of the approved variance
permit; and
WHEREAS, the extension request states that the permittee is currently working with a
contractor to develop plans to fit the site;
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. There is no indication that circumstances have changed sufficiently since the
variance was issued on November 5, 1997.
Section 2. The variance issued to Diane and Joe Owens on November 5, 1997, is hereby
extended until November 5, 1998.
Section 3. This resolution shall take effect immediately upon its adoption.
