FOR THE CONSTRUCTION OF FOUR TOWNHOUSE DWELLING UNITS ON LOT llA, OCEANVIEW SUBDIVISION, NO. 10 AND LOT 12, BLOCK 10, FEDERAL ADDITION, AS AUTHORIZED BY SEWARD CITY CODE SECTION 15.10.320 WHEREAS, Spinell Homes Inc. requested a Conditional Use Permit for the construction of four townhouses on Lot l1A, Oceanview Subdivision, No. 10 and Lot 12, Block 10, Federal Addition; and WHEREAS, an application meeting the requirements of Section 15. 10. 320(B) , was submitted and received on February 10, 1999; and WHEREAS, this request is located on land zoned Auto Commercial (AC); and WHEREAS, in accordance with the Land Uses Allowed Table (15.10.225), attached single-family dwellings (townhouses) are permitted within the AC Zoning District by Conditional Use Permit (CUP); and WHEREAS, a duly advertised public hearing, meeting the requirements of Section 15.01.040 was held by the Commission on March 3, 1999. NOW, THEREFORE, BE IT RESOLVED BY THE SEWARD PLANNING AND ZONING COMMISSION of the City of Seward that: Section 1. In accordance with SCC ~ 15.10.320 (D), the Planning and Zoning Commission has reviewed the applicant's request for a CUP to construct four townhouses on Lot llA, Oceanview Subdivision, No. 10 and Lot 12, Block 10, Federal Addition and made the following Findings of Fact: A. A completed application and fee was submitted. This condition has been met. The application and $250.00 fee was received by the city on February 10, 1999. B. D. The proposed use is in harmony with the Seward Comprehensive Plan. It appears that the use is in harmony with the Seward Comprehensive Plan based on the following excerpts from the Plan: *' Developable Land In Seward Is Scarce Yet There Is A Demand To Accommodate As Much Projected Demand For Housing As Possible Within the City Limits In Order To Ensure Sound Community Growth and Development *' Continue every effort to encourage the development of affordable housing for Seward's growing housing needs -- including single- and multi-family housing units E. Public Services and facilities are adequate to serve the proposed site. Adequate water, sewer and power appear to be available to the property as well as adequate police and solid waste disposal services. According to the Fire Chief the developer will be required install a new fIre hydrant near the project site, because all of the existing hydrants exceed the 250 foot requirement. There appears to be adequate space on the east side of the property, adjacent to the alley/for fuel/propane tanks and garbage disposal containers. F. The proposed use will not be harmful to the public safety, health or welfare. There is no indication that the proposed development of additional housing will be harmful to the public safety, health or welfare. Because the development is zero lot line, the Uniform Building Code requires fIre walls between each of the units. G. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions shall be met by the applicant. These may include but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects to the proposed use. Section 2. Based on the Findings of Fact specifIed in Section 1, the Planning and Zoning Commission authorizes the Community Development Department to issue a Conditional Use Permit to Spinell Homes Inc. for the construction of four townhouses on Lot l1A, Oceanview Subdivision No. 10, and Lot 12, Block 10, Federal Addition subject to all parking areas and driveways will be paved within one year from the issuance of the certifIcate of occupancy. Section 3. This resolution shall take effect 10 days following its adoption.
