HomeMy WebLinkAboutRes2001-012 Sponsored by Staff CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 2001-12 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, GRANTING THE THE AMERICAN LEGION #5 AND IRON MOUNTAIN SHOOTING CLUB A CONDITIONAL USE PERMIT TO DEVELOP AND OPERATE A SHOOTING RANGE ON PROPERTY LOCATED AT THE END OF DIMOND BOULEVARD DESCRIBED AS THE NE%, NE% OF SECTION 28, TIN, RIW, SEWARD MERIDIAN, AND FURTHER IDENTIFIED AS KENAI PENINSULA BOROUGH TAX PARCEL NUMBER 144-240-05 WHEREAS, the American Legion #5 and Iron Mountain Shooting Club have jointly applied for a Conditional Use Permit to develop and operate a rifle and pistol range on a portion of the NE% of Section 28, TIN, Rl W, Seward Meridian and further identified as Kenai Peninsula Borough Tax Parcel Number 144-240-05; and WHEREAS, the property is owned by the Kenai Peninsula Borough and leased to the American Legion #5; and WHEREAS, the subject property is zoned Institutional; and WHEREAS, according to the Zoning Code, Land Uses Allowed Table, (15.10.225) a shooting range is allowed in the Institutional District by Conditional Use Permit; and WHEREAS, in June 1997, the Planning and Zoning Commission granted the American Legion a Conditional Use Permit to develop and operate a rifle and pistol range on described property, however the CUP expired because the use was not initiated within six months and a time extension was not requested; and WHEREAS, a duly advertised public hearing, meeting the requirements of SCC Section 15.01.040 was held by the Commission on September 4,2001. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. According to SCC ~ 15.l0.320.D., the Commission shall establish a finding that the use satisfies the following conditions prior to granting a conditional use permit: A. The use is consistent with the purpose of this chapter (the Seward Zoning Code) and the purposes of the zoning district. Finding: This condition has been met. The property is zoned Institutional. The Zoning Code allows a shooting range in the Institutional District by conditional use permit. Permittee shall obtain Chief of Police approval ofthe shooting range; 2. Permittee shall provide no less than one off-street parking space per target; 3. The ATCO building will be placed on site, and shall be subject to approval by the building official; 4. No ammunition will be stored in the storage/office building; 5. Development of the shooting range shall adhere to the National Rifle Association's safety standard specifications; 6. The proposed access road must be constructed in accordance with Fire Code requirements; 7. The shooting range will only be open when an approved range master is supervising the site; 8. Supervising range masters must have some form of communication, such as a radio or cellular phone, to contact emergency services if necessary. 9. Per the 1997 Uniform Fire Code, Appendix II-D the following terms will be met: a. The range will be supervised by a range master who is certified by a recognized authority. b. All range masters will be approved in writing by the Seward Fire Department and the Seward Police Department. c. A plan will be submitted to and approved by the City of Seward Fire Department which will address inspection of expended ammunition compo- nents and the disposal of malfunctioning ammunition. d. Portable fire extinguishers will be installed as required by the Seward Fire Department. e. The area of designated use will be kept clear of vegetation as specified by the Seward Fire Department. f. In lieu of protective fencing, warning signs will be posted completely around the perimeter of the facility to provide a warning to all approaches. 10. The shooting range shall be assigned a street address different from the Borough Transfer Facility. 11. Permittee will provide the Community Development Office with an accurate site plan of the lease parcel. Section 2. The Planning and Zoning Commission finds that the proposed use satisfies the conditions for granting a conditional use permit, and authorizes the administration to issue a Conditional Use Permit to the American Legion #5 and Iron Mountain Shooting Club for the development and operation of shooting range on the NE v.., NE v.. of Section 28, TIN, Rl W, Seward Meridian, subject to the conditions listed in Section 1, Subsection F. Section 3. The Planning and Zoning Commission finds that adherence to the conditions of this permit is paramount in maintaining the intent of Seward City Code Section 15.10.320 Conditional use permits, and authorizes the administration to confirm all conditions are satisfied prior to the use being initiated.
