The sign code authorizes one freestanding sign per street frontage. However, in the Auto Commercial Zoning District, Three Bears fuel station was granted a variance allowing a free standing sign of twenty (20) feet in height containing one thirty-six (36) square foot internally illuminated panel and one thirty-six (36) square foot internally illuminated fuel price panel. The neighboring Essential 1 fuel station was granted a variance allowing a free standing sign of twenty-five feet (25) in height containing three thirty-six (36) square foot internally illuminated panels, including the fuel price panel. b. That such variance is necessary because of special circumstances such as, but not limited to, health and safety or the size, shape, topography, location or surroundings of the subject property, to provide it with signage use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located; Finding: This condition has not been met. The property is paved, level and has approximately 100 feet of frontage on the Seward Highway and approximately 133 feet of frontage on North Harbor Street. The adjacent Seward Highway has a 35 mile-per-hour speed limit and the adjacent North Harbor Street has a 25 per mile-per-hour speed limit. Having a large free standing sign of twenty-eight (28) feet adds to the visual street side clutter caused by signage and detracts from the aesthetic appeal of the community, lowering it to twenty (20) feet would help mitigate this impact. c. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the subject property or improvements in the vicinity and in the zone in which the subject property is situated. Finding: This finding has been met by the conditions of the sign ordinance variance by reducing the height of the sign to twenty (20) feet to lessen the visual impact in the Harbor Commercial (He) Zoning District. 4. In granting a variance, the commission may attach thereto such conditions regarding the location, character and other features of the proposed sign as it may deem necessary to carry out the spirit and purpose of this code of moderating the size, number and obtrusive placement of signs and reduction of clutter in the public interest Section 2.
