HomeMy WebLinkAboutRes2005-025 Sponsored by: Applicant CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2005-25 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION OF THE CITY OF SEWARD, ALASKA, GRANTING A CONDITIONAL USE PERMIT TO THE BREEZE INN FOR A HOTEL EXPANSION ON LOT 3B, BLOCK 1, MARINA SUBDIVISION, MINDENBERGS REPLAT IN THE HARBOR COMMERCIAL ZONING DISTRICT WHEREAS, the Breeze Inn. has applied for a conditional use permit from the Seward Planning and Zoning Commission for a hotel expansion containing 14 rooms at Lot 3B, Block 1, Marina Subdivision, Mindenbergs Replat, Seward Small Boat Harbor; and WHEREAS, the property is located in the Harbor Commercial Zoning District; and WHEREAS, according to the Seward City Code, Land Uses Allowed Table 15.10.225, hotels are allowed in the Harbor Commercial Zoning District as a conditionally permitted use; and WHEREAS, the current Breeze Inn Hotel was built before the requirement of a conditional use permit as addressed in the Seward Zoning Code under Title &15.10.315, H. Nonconforming lots, structures and uses; and WHEREAS, a use that was legal and did not require a conditional use permit when it was initiated, but which would now require a conditional use permit under the terms of this chapter, shall be considered a legal conforming use and may continue to exist as a conditional use subject to the provisions of this chapter and may be modified in accordance with section &15.10.320. The available public and private parking does not meet the current parking needs of existing businesses and the Marina (page 13); . Recommends increased landscaping in conjunction with development projects (page 21), D. Public Services and facilities are adequate to serve the proposed use. Finding: Water, sewer, telephone and electrical service are available to the property, as well as adequate emergency services. Garbage dumpsters are available onsite. Public utility easements are onsite and there shall not be any encroachments, above or below ground, in the utility easements. E. The proposed use will not be harmful to the public safety, health or welfare. Finding: Utilizing North Harbor Street will create more traffic congestion due to left hand turns being made to enter and leave the property. Restricting the flow of traffic onsite to one-way, going from North to South will mitigate a significant amount of congestion. Providing adequate parking for the guest rooms will mitigate parking concerns in the area. Runoff from storm water and snow melt can be mitigated by having a landscape plan which incorporates retention and a slower rate of discharge off site. F. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions shall be met by the applicant. These may include but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. 1. One off-street parking space per guest unit shall be provided for the life of the hotel. The required parking must meet the requirements of Seward City Parking Code 15.10.215 and the American Disabilities Act. 2. A landscaping plan shall be approved by staff and shall contribute to the retention of storm water runoff. 3. Modifications to the site plan dated October 27, 2005 which was approved by the Commission as a supporting document for this Conditional Use Permit, shall be approved by staff or the Commission prior to implementation.
